Active Mobility
(Esplanade Waterfront Theatre Construction —
Exemption) Order 2021
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and commencement
1.  This Order is the Active Mobility (Esplanade Waterfront Theatre Construction — Exemption) Order 2021 and comes into operation on 15 March 2021.
Definitions
2.  In this Order —
“Expand Construction Pte. Ltd.” means the company incorporated under the Companies Act (Cap. 50) as Expand Construction Pte. Ltd. (UEN 200005999D);
“specified activity” means the use of motor vehicles by Expand Construction Pte. Ltd. to transport any individual or thing in connection with the construction of the Esplanade Waterfront Theatre from 15 March 2021 to 7 August 2021 (both dates inclusive);
“specified footpath” means the part of the footpath delineated by the black‑coloured line in the map set out in the Schedule.
Exemption for driving motor vehicle
3.  Section 16(1)(b) of the Act does not apply to an individual who drives a motor vehicle on the specified footpath during and for the purpose of the specified activity, under the following conditions:
(a)the individual is authorised by Expand Construction Pte. Ltd. to drive the motor vehicle;
(b)the individual who drives the motor vehicle —
(i)drives at a speed not exceeding 10 km/h; and
(ii)gives way to other users of the specified footpath;
(c)the individual who drives the motor vehicle possesses a valid driving licence granted under the Road Traffic (Motor Vehicles, Driving Licences) Rules (Cap. 276, R 27) authorising the individual to drive that vehicle;
(d)there is in force, at any time the motor vehicle is used in connection with the specified activity, a policy of insurance in relation to the motor vehicle insuring against any liability in respect of the death of or bodily injury sustained by any person (other than the driver or any passenger of the motor vehicle), or property damage suffered by any person (other than the driver or any passenger of the motor vehicle), caused by or arising out of the use of the motor vehicle;
(e)the risk under the policy of insurance mentioned in sub‑paragraph (d) is assumed by an insurer who, at the time of the issuance of the policy, is lawfully carrying on an insurance business in Singapore.
