(Tour de Care 2024 — Exemption)
Order 2024
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation and period in force
1.—(1)  This Order is the Active Mobility (Tour de Care 2024 — Exemption) Order 2024.
(2)  This Order is in force on 30 March 2024.
Definitions
2.  In this Order —
“emergency” means an actual or imminent event that causes, or threatens to cause —
(a)any harm or danger to the life, health or safety of any individual;
(b)any destruction of, or damage to, any property; or
(c)any harm or danger to the health or safety of the public;
“recumbent device” and “three-wheeled pedal cycle” have the meanings given by regulation 2 of the Active Mobility Regulations 2018 (G.N. No. S 251/2018);
“specified event” means the Tour de Care 2024 event organised by UNMARKED EVENTS PTE. LTD. on 30 March 2024;
“specified footpath” means the footpath delineated by the black‑coloured line in the map set out in the Schedule;
“specified motor vehicle” means a motor vehicle other than the following:
(a)a motorised personal mobility device;
(b)a power-assisted bicycle;
(c)a motorised wheelchair;
(d)a mobility scooter;
(e)an automatic detection device that has wheels and a motor and is constructed to drive itself;
(f)a robotic machine designed to move and operate independently of human control when the computer that controls it is programmed;
(g)a motor vehicle that is constructed to drive itself;
“UNMARKED EVENTS PTE. LTD.” means the company incorporated under the Companies Act 1967 as UNMARKED EVENTS PTE. LTD. (UEN 202116851Z).
Exemption for riding bicycle, three-wheeled pedal cycle or recumbent device
3.  Section 21(1)(a) of the Act and regulations 3A(1)(a) and (b) and 4(1)(b) and (c) of the Active Mobility Regulations 2018 do not apply to an individual who rides a bicycle, three‑wheeled pedal cycle or recumbent device on a specified footpath during the specified event under the following conditions:
(a)the individual is registered with UNMARKED EVENTS PTE. LTD. as a participant of the specified event;
(b)the bicycle, three-wheeled pedal cycle or recumbent device —
(i)has a width not exceeding 1,300 millimetres; and
(ii)has a length not exceeding 2,600 millimetres;
(c)there is in force, at any time the bicycle, three‑wheeled pedal cycle or recumbent device is so ridden, a policy of insurance in relation to the bicycle, three‑wheeled pedal cycle or recumbent device insuring against any liability in respect of —
(i)the death of or bodily injury sustained by any person (whether or not including the rider); and
(ii)any property damage suffered by any person (whether or not including the rider),
caused by or arising out of the use of the bicycle, three‑wheeled pedal cycle or recumbent device;
(d)the risk under the policy of insurance mentioned in sub‑paragraph (c) is assumed by an insurer who, at the time the policy is issued, is lawfully carrying on an insurance business in Singapore.
Exemption for driving specified motor vehicle
4.  Section 16(1)(b) of the Act does not apply to an individual who drives a specified motor vehicle on a specified footpath under the following conditions:
(a)the individual is authorised by UNMARKED EVENTS PTE. LTD. to drive the specified motor vehicle;
(b)the individual who drives the specified motor vehicle possesses a valid driving licence granted under the Road Traffic (Motor Vehicles, Driving Licences) Rules (R 27) authorising the individual to drive the class of the specified motor vehicle;
(c)the specified motor vehicle is driven to facilitate the execution of the specified event, or to transport people or things in connection with the specified event;
(d)the individual, when driving the specified motor vehicle —
(i)must drive at a speed not exceeding 10 km/h unless responding to an emergency; and
(ii)must give way to other users of the specified footpath;
(e)there is in force, at any time the specified motor vehicle is driven in connection with the specified event, a policy of insurance in relation to the specified motor vehicle insuring against any liability in respect of —
(i)the death of or bodily injury sustained by any person (whether or not including the driver); and
(ii)any property damage suffered by any person (whether or not including the driver),
caused by or arising out of the use of the specified motor vehicle;
(f)the risk under the policy of insurance mentioned in sub‑paragraph (e) is assumed by an insurer who, at the time the policy is issued, is lawfully carrying on an insurance business in Singapore.
