(Scholarships, Bursaries and Awards)
(Amendment) Regulations 2024
In exercise of the powers conferred by section 35 of the Education Endowment and Savings Schemes Act 1992, the Minister for Education makes the following Regulations:
Citation and commencement
1.  These Regulations are the Education Endowment and Savings Schemes (Scholarships, Bursaries and Awards) (Amendment) Regulations 2024 and come into operation on 30 October 2024.
Amendment of regulation 2
2.  In the Education Endowment and Savings Schemes (Scholarships, Bursaries and Awards) Regulations (Rg 4) (called in these Regulations the principal Regulations), in regulation 2 —
(a)in the definition of “academic award”, delete “(d),”;
(b)replace the definition of “course” with —
“ “course”, in relation to a pupil, means a course approved by the Minister for the purposes of this Part that is offered by the primary or secondary school, junior college, polytechnic, Institute of Technical Education or specified educational institution in which the pupil is enrolled;
“cut‑off date”, in relation to a scholarship, bursary or award under these Regulations for any academic year, means the date specified by the Ministry on which the selection process for that scholarship, bursary or award is to be completed;”;
(c)delete the definitions of “independent integrated programme school”, “integrated programme pupil”, “integrated programme school” and “non‑independent integrated programme school”;
(d)replace the definitions of “relevant examinations” and “relevant subjects” with —
“ “pupil’s average rank”, for any year, means the average of a pupil’s subject ranks for that year in the relevant subjects;
“pupil’s subject rank”, for any year, means the pupil’s rank, based on relevant assessments, in a relevant subject among all other pupils in the educational institution in which the pupil is enrolled who —
(a)are in the same level and course as the pupil; and
(b)take that subject at the same subject level as the pupil;
“relevant assessments”, in relation to a pupil’s eligibility for a scholarship, bursary or award under these Regulations for any academic year, means any test, examination or other method of assessing a person’s level of proficiency, aptitude, skill, knowledge or understanding in a subject, that is conducted in that academic year —
(a)by the primary or secondary school, junior college, polytechnic, Institute of Technical Education or specified educational institution in which a pupil is enrolled; and
(b)for pupils in the same level, course and subject level (if applicable) as the pupil;
“relevant pupil” means a pupil who —
(a)is enrolled in —
(i)an independent school at the secondary level; or
(ii)a Government secondary school, Government‑aided secondary school, Government junior college, Government‑aided junior college or specified educational institution for his secondary education; and
(b)is at —
(i)the secondary two, three, four or five level in 2024;
(ii)the secondary three, four or five level in 2025; or
(iii)the secondary four or five level in 2026;
“relevant subjects”, in relation to a scholarship, bursary or award under these Regulations, means the subjects determined by the Minister to be relevant in assessing a pupil’s overall academic performance for the purposes of that scholarship, bursary or award;”; and
(e)delete the definition of “special additional miscellaneous fees”.
Amendment of regulation 4
3.  In the principal Regulations, in regulation 4 —
(a)in paragraph (1), delete sub‑paragraph (d); and
(b)after paragraph (1B), insert —
(1C)  Subject to paragraphs (1D) and (1E), a pupil’s eligibility for a scholarship, bursary or award under these Regulations is determined based on the information received by the Ministry on or before the cut‑off date for that scholarship, bursary or award.
(1D)  Despite paragraph (1C), a scholarship, bursary or award under these Regulations may be awarded to a pupil based on information received by the Ministry after the cut‑off date for that scholarship, bursary or award, if the information was not received by the Ministry on or before the cut‑off date due to an error or omission by the educational institution in which the pupil is enrolled or the Ministry.
(1E)  Despite anything in these Regulations, a scholarship, bursary or award under these Regulations awarded to a pupil may be terminated or revoked if the pupil has (before, on or after the cut‑off date) behaved in a manner that makes it undesirable for the pupil to hold the scholarship, bursary or award, as the case may be.”.
Amendment of regulation 8
4.  In the principal Regulations, in regulation 8, replace paragraph (d) with —
(d)if the pupil is —
(i)enrolled in an independent school at the secondary level and —
(A)is a relevant pupil — the pupil stands among the 10% of all pupils in the pupil’s level and course who have obtained the best aggregate scores in the relevant assessments; or
(B)is not a relevant pupil — the pupil is ranked in the top 10% of all pupils in the pupil’s level and course based on each pupil’s average rank for that year; or
(ii)enrolled in an independent school at the pre‑university level — the pupil stands among the 10% of all pupils in the pupil’s level and course who have obtained the best aggregate scores in the relevant assessments;”.
Deletion of Part V
5.  In the principal Regulations, delete Part V.
Amendment of regulation 23
6.  In the principal Regulations, in regulation 23 —
(a)in paragraph (1), replace sub‑paragraph (c) with —
(c)if the pupil —
(i)is a relevant pupil — has obtained the qualifying score in the relevant assessments; or
(ii)is not a relevant pupil — is ranked in the top 10% of all pupils in the pupil’s level and course based on each pupil’s average rank for that year; and”; and
(b)replace paragraph (2) with —
(2)  In this regulation, “qualifying score”, in relation to a pupil (called the specified pupil), means the lowest aggregate score which is obtained by any pupil standing among the 10% of all pupils in the same level and course as the specified pupil who have obtained the highest aggregate scores in the relevant assessments.”.
Amendment of regulation 26
7.  In the principal Regulations, in regulation 26 —
(a)in paragraph (1), delete sub‑paragraph (ba); and
(b)replace paragraph (2) with —
(2)  In this regulation, “qualifying score”, in relation to a pupil (called the specified pupil), means the lowest aggregate score which is obtained by any pupil standing among the 10% of all pupils in the same level and course as the specified pupil who have obtained the highest aggregate scores in the relevant assessments.”.
Amendment of regulation 30
8.  In the principal Regulations, in regulation 30 —
(a)in paragraph (1)(d)(i), delete “and” at the end;
(b)in paragraph (1)(d), replace sub‑paragraph (ii) with —
(ii)if the pupil is enrolled at the primary level or the pre‑university level — the pupil has obtained the qualifying score in the relevant assessments; and
(iii)if the pupil is enrolled at the secondary level and —
(A)is a relevant pupil — the pupil has obtained the qualifying score in the relevant assessments; or
(B)is not a relevant pupil — the pupil is ranked in the top 25% of all pupils in the pupil’s level and course based on each pupil’s average rank for that year; and”;
(c)in paragraph (1)(e), replace sub‑paragraph (ii) with —
(ii)he has obtained the qualifying score in the relevant assessments.”; and
(d)replace paragraph (2) with —
(2)  In this regulation, “qualifying score”, in relation to a pupil (called the specified pupil), means the lowest aggregate score which is obtained by any pupil standing among the 25% of all pupils in the same level and course as the specified pupil who have obtained the highest aggregate scores in the relevant assessments.”.
Amendment of regulation 35
9.  In the principal Regulations, in regulation 35 —
(a)in paragraph (1)(a)(i), replace “education” with “educational”;
(b)in paragraph (1)(c), replace sub‑paragraph (ii) with —
(ii)has demonstrated a substantial improvement, as determined by the educational institution in which he is enrolled, in the relevant assessments;”;
(c)in paragraph (1)(d), replace sub‑paragraph (ii) with —
(ii)has demonstrated a substantial improvement, as determined by the polytechnic or the Institute of Technical Education of which he is a full‑time pupil, in the relevant assessments.”;
(d)in paragraph (2)(a), replace sub‑paragraph (iii) with —
(iii)a pupil who failed to progress to the next level of studies from the previous academic year; or”;
(e)in paragraph (2)(b), replace sub‑paragraph (iii) with —
(iii)a pupil who failed to progress to the next level of studies from the previous academic year;”;
(f)in paragraph (2)(c), replace sub‑paragraph (ii) with —
(ii)a pupil who failed to progress to the next level of studies from the previous academic year.”; and
(g)in paragraph (3), replace “ranking in the relevant examinations conducted by that secondary school or junior college in that year and the pupil’s ranking in the relevant examinations taken by the pupil in the previous year” with “rankings in the relevant assessments conducted in that academic year and the previous academic year”.
Amendment of regulation 37
10.  In the principal Regulations, in regulation 37 —
(a)in paragraph (1)(a)(i), replace “college, Government‑aided junior college or specified educational institution” with “college or Government‑aided junior college”;
(b)in paragraph (1)(a)(ii), after “Education”, insert “or enrolled in a specified educational institution”;
(c)in paragraph (1)(c), replace sub‑paragraph (ii) with —
(ii)has demonstrated leadership qualities, service to community and schools, excellence in non‑academic activities, or future‑ready competencies, as determined by the educational institution in which the pupil is enrolled; and”;
(d)in sub‑paragraph (d)(i), after “Education”, insert “or the specified educational institution”; and
(e)in sub‑paragraph (d), replace sub‑paragraph (ii) with —
(ii)has demonstrated leadership qualities, service to community and schools, or excellence in non‑academic activities, as determined by the educational institution in which the pupil is enrolled.”.
Amendment of regulation 38C
11.  In the principal Regulations, in regulation 38C —
(a)in paragraph (c), delete “and” at the end;
(b)in paragraph (d), replace the full‑stop at the end with “; and”; and
(c)after paragraph (d), insert —
(e)has demonstrated exemplary character and outstanding personal qualities through the pupil’s behaviour and actions, as determined by the educational institution in which the pupil is enrolled.”.
Amendment of regulation 38E
12.  In the principal Regulations, in regulation 38E(d)(i) and (e)(i), after “in the”, insert “penultimate or”.
Amendment of Schedule
13.  In the principal Regulations, in the Schedule —
(a)in the Schedule reference, delete “21(1),”;
(b)delete item 5; and
