Misuse of Drugs
(Amendment) Regulations 2024
In exercise of the powers conferred by section 58 of the Misuse of Drugs Act 1973, the Minister for Home Affairs makes the following Regulations:
Citation and commencement
1.  These Regulations are the Misuse of Drugs (Amendment) Regulations 2024 and come into operation on 1 June 2024.
Amendment of regulation 7
2.  In the Misuse of Drugs Regulations (Rg 1) (called in these Regulations the principal Regulations), in regulation 7(2), replace sub‑paragraph (g) with —
(g)an analyst or any other laboratory staff member employed by the Health Sciences Authority;”.
Amendment of regulation 8
3.  In the principal Regulations, in regulation 8(2), replace sub‑paragraph (g) with —
(g)an analyst or any other laboratory staff member employed by the Health Sciences Authority;”.
Amendment of regulation 8A
4.  In the principal Regulations, in regulation 8A, replace paragraph (c) with —
(c)an analyst or any other laboratory staff member employed by the Health Sciences Authority;”.
Amendment of Fourth Schedule
5.  In the principal Regulations, in the Fourth Schedule —
(a)in paragraph 15, after item (8AB), insert —
“(8AC)
1-(3-Chlorophenyl)-2-(methylamino)propan-1-one (also known as 3‑chloromethcathinone or 3‑CMC)”;
(b)in paragraph 17, after item (2A), insert —
“(2AA)
N-(1-Amino-3,3-dimethyl-1-oxobutan-2-yl)-1H-indazole-3-carboxamide (also known as ADB‑INACA or ADMB-INACA) and its N‑(1‑amino‑1‑oxohexan‑2‑yl) isomers”;
(c)in paragraph 17, replace item (6H) with —

1-(1-(1-(4-Bromophenyl)ethyl)-piperidin-4-yl)-1,3-dihydro-2H-benzimidazol-2-one (also known as Brorphine) and its bromo positional isomers in the phenyl ring”;
(d)in paragraph 17, after item (19AA), insert —

2-(Ethylamino)-2-(2-fluorophenyl)-cyclohexanone (also known as 2‑fluorodeschloro‑N‑ethyl‑ketamine, 2‑FDCNEK, 2‑fluoro‑2‑oxo PCE or 2‑fluoro NENDCK) and its fluoro positional isomers in the phenyl ring”;
(e)in paragraph 17, renumber the existing item (19AB) relating to “4‑Fluoromethylphenidate and its fluoro positional isomers in the phenyl ring” as item (19B);
(f)in paragraph 17, after item (27AA), insert —

2-(1H-Indazole-3-carboxamido)-3,3‑dimethylbutanoic acid and its hexanoic acid isomers”;
(g)in paragraph 18, after item (10), insert —

5,6-Dimethoxy-N,N-diisopropyltryptamine (also known as 5,6‑Dimethoxy‑DiPT or 5,6‑MeO‑DiPT)”;
(h)in paragraph 20, after item (10), insert —
“(10A)
N-(1-Amino-3,3-dimethyl-1-oxobutan-2-yl)-1-(4,5-dihydroxypentyl)-1H-indazole-3-carboxamide”;
(i)in paragraph 20, after item (13), insert —
“(13A)
N-(1-Amino-3,3-dimethyl-1-oxobutan-2-yl)-1-(4-hydroxycyclohexylmethyl)-1H-indazole-3-carboxamide
(13B)
N-(1-Amino-3,3-dimethyl-1-oxobutan-2-yl)-1-(pent-4-en-1-yl)-1H-indazole-3-carboxamide (also known as ADB-4en-PINACA, ADMB-4en-PINACA or ADB-PENINACA)”; and
(j)in paragraph 20, after item (36B), insert —

Methyl 2-(1-butyl-1H-indazole-3-carboxamido)-3,3-dimethylbutanoate (also known as MDMB‑BUTINACA or MDMB-BINACA)”.
