Misuse of Drugs
(Approved Institutions, Medical Observation and
Treatment and Rehabilitation) (Amendment)
Regulations 2024
In exercise of the powers conferred by section 58 of the Misuse of Drugs Act 1973, the Minister for Home Affairs makes the following Regulations:
Citation and commencement
1.  These Regulations are the Misuse of Drugs (Approved Institutions, Medical Observation and Treatment and Rehabilitation) (Amendment) Regulations 2024 and come into operation on 1 June 2024.
Amendment of regulation 12
2.  In the Misuse of Drugs (Approved Institutions, Medical Observation and Treatment and Rehabilitation) Regulations (Rg 3) (called in these Regulations the principal Regulations), in regulation 12 —
(a)in paragraph (2)(e), replace “drug” with “controlled drug or psychoactive substance”; and
(b)replace paragraph (5) with —
(5)  Any inmate who fails to return to the approved institution after the leave granted to the inmate has been cancelled under paragraph (4) —
(a)is deemed to be unlawfully at large; and
(b)shall be guilty of an offence.
(5A)  A person who is guilty of an offence under paragraph (5) shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 3 years or to both.”.
Amendment of regulation 13
3.  In the principal Regulations, in regulation 13, after paragraph (2), insert —
(2A)  Any inmate who fails to return to the approved institution after the leave granted to the inmate has been cancelled under paragraph (2) —
(a)is deemed to be unlawfully at large; and
(b)shall be guilty of an offence.
(2B)  A person who is guilty of an offence under paragraph (2A) shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 3 years or to both.”.
Amendment of regulation 15
4.  In the principal Regulations, in regulation 15(3)(h) and (i), after “controlled drug”, insert “or psychoactive substance”.
Amendment of regulation 16
5.  In the principal Regulations, in regulation 16(1)(b), after “controlled drug”, insert “or psychoactive substance”.
