(Water Supply)
(Amendment No. 2) Regulations 2021

In exercise of the powers conferred by section 72 of the Public Utilities Act, the Public Utilities Board, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:

Citation and commencement

1. These Regulations are the Public Utilities (Water Supply) (Amendment No. 2) Regulations 2021 and come into operation on 1 January 2022.

Amendment of regulation 2

2. Regulation 2 of the Public Utilities (Water Supply) Regulations (Rg 5) (called in these Regulations the principal Regulations) is amended —

(a)

by inserting, immediately after the definition of “sub‑meter”, the following definition:

“ “urinal flush valve” means a flush valve serving a urinal;”; and

(b)

by deleting the full-stop at the end of the definition of “Water Efficiency Label” and substituting a semi‑colon, and by inserting immediately thereafter the following definition:

“ “water‑closet flush valve” means a flush valve serving a water‑closet pan.”.

New regulation 34A

3. The principal Regulations are amended by inserting, immediately after regulation 34, the following regulation:

“Connection of premises to water main

34A. The Board may, on receiving payment of the relevant fee specified in the Third Schedule, connect any premises to any water main belonging to or under the management or control of the Board for the purpose of supplying water to those premises.”.

Amendment of regulation 36

4. Regulation 36 of the principal Regulations is amended by deleting paragraph (15) and substituting the following paragraph:

“(15) Where the Board has discontinued the supply of water to any premises under the Act, the Board may (after receiving payment of the relevant fee specified in the Third Schedule) resume the supply of water to those premises under section 37(2) of the Act.”.

Amendment of regulation 40A

5. Regulation 40A of the principal Regulations is amended —

(a)

by inserting, immediately after the definition of “affix”, the following definitions:

“ “high pressure washer” means a machine or tool that uses high pressure water spray to clean surfaces and objects;

“hood dishwasher” means a manually loaded, programmable, hood‑type pass‑through dishwasher that typically has a detergent circulating zone and a freshwater rinsing process;”;

(b)

by inserting, immediately after paragraph (c) of the definition of “specified water fitting”, the following paragraph:

“(ca)

a water‑closet flush valve;”;

(c)

by inserting, immediately after paragraph (e) of the definition of “specified water fitting”, the following paragraph:

“(ea)

a washer extractor (other than for household use) that is —

(i)	designed to be loaded or unloaded through an opening in the front of the washer extractor; or
(ii)	designed to be loaded or unloaded through an opening in the top of the washer extractor;”;

(d)

by inserting, immediately after paragraph (f) of the definition of “specified water fitting”, the following paragraphs:

“(g)

a dishwasher (other than for household use) that is of any of the following types:

(i)	a hood dishwasher;
(ii)	an undercounter dishwasher;

(h)

a high pressure washer other than for any of the following uses:

(i)	household use;
(ii)	steam cleaning or hot water pressure washing;
(iii)	washing equipment or vehicles;”; and

(e)

by inserting, immediately after the definition of “test report”, the following definition:

“ “undercounter dishwasher” means a manually loaded, programmable, undercounter front‑loading dishwasher that typically has a detergent circulating zone and a freshwater rinsing process;”.

Amendment of regulation 40AA

6. Regulation 40AA of the principal Regulations is amended by inserting, immediately after paragraph (1), the following paragraph:

“(1A) Paragraph (1)(b) does not apply to a specified water fitting that is of a description or type mentioned in paragraph (ea), (g) or (h) of the definition of “specified water fitting” in regulation 40A.”.

Amendment of regulation 40AB

7. Regulation 40AB of the principal Regulations is amended by inserting, immediately after paragraph (2A), the following paragraph:

“(2B) Paragraph (2)(a) does not apply to a specified water fitting that is of a description or type mentioned in paragraph (ea), (g) or (h) of the definition of “specified water fitting” in regulation 40A.”.

Amendment of First Schedule

8. Paragraph 18 of the First Schedule to the principal Regulations is amended —

(a)	by deleting the words “flush valve serving a water‑closet pan” in sub‑paragraph (2) and substituting the words “water‑closet flush valve”;
(b)	by deleting the words “4.5 litres” in sub‑paragraph (2) and substituting the words “4 litres”; and
(c)	by deleting the words “flush valve serving a urinal” in sub‑paragraph (3) and substituting the words “urinal flush valve”.

Amendment of Part 1 of Second Schedule

9. Part 1 of the Second Schedule to the principal Regulations is amended —

(a)

by inserting, immediately after item (3) of paragraph 1, the following item:

The test method for determining the flow rate set out in paragraph 4C”;

(f)

by inserting, immediately after paragraph 3, the following paragraph:

“3A. The flush volume for a water‑closet flush valve is the mean of the flush volumes measured (in litres per flush) with the following test method at the dynamic pressures of 1.5 bars, 2 bars and 3 bars:

(a)

the flush pipe must —

(i)	be 300 mm long;
(ii)	have an internal diameter of at least 25 mm; and
(iii)	be secured to the outlet of the flush valve;

(b)

the pressure gauge and control valve must be fitted at the inlet of the flush valve;

(c)

the flush valve must be connected to a water supply system and the dynamic pressure of the water supply must be adjusted to one bar;

(d)

the flow regulator must be set at maximum;

(e)

the operating member must continue to be held actuated until the flow of water ceases;

(f)

the flush volume is the volume of water that is discharged from the flush pipe from the actuation of the operating member to the cessation of the flow of water.”;

(g)

by inserting, immediately after the words “water consumption for a clothes washing machine” in paragraph 4, the words “intended for household use”;

(h)

by inserting, immediately after paragraph 4, the following paragraph:

“4AA. The water consumption for a washer extractor (other than for household use) is to be measured using the wash programme or other associated settings recommended in the manufacturer’s product literature for a nominal load at rated load capacity, and the following are not required as a test condition:

(a)	the use of a reference washer extractor;
(b)	the use of a specific ambient temperature or humidity;
(c)	the use of a specific inlet water hardness, water pressure or water temperature;
(d)	the use of a specific type of energy supply;
(e)	the use of an electricity supply at a specific voltage;
(f)	the use of a specific compressed air supply;
(g)	the use of a specific steam supply;
(h)	the use of stain and soil monitors, wash process control sheets or rinse performance fabrics;
(i)	the use of detergent;
(j)	the determination of wash performance.”;

(i)

by inserting, immediately after the words “water consumption for a dishwasher” in paragraph 4A, the words “intended for household use”; and

(j)

by inserting, immediately after paragraph 4A, the following paragraphs:

“4B. The water consumption for a hood dishwasher or an undercounter dishwasher (other than for household use) is to be measured using the wash programme specified in Clause 5.4 of IEC 63136:2019, and the following are not required as a test condition:

(a)	a cleaning and resoiling performance test;
(b)	the conditioning of the dishwasher under test and sequence of test procedures;
(c)	the use of an electricity supply at a specific voltage;
(d)	the use of specific ambient conditions;
(e)	the use of a specific inlet water hardness, water pressure or water temperature;
(f)	the use of detergent;
(g)	the use of rinse aid;
(h)	the measurement of the temperature of any rack in the dishwasher.

4C. The flow rate for a high pressure washer is measured with the following test method:

(a)

the high pressure washer must be connected to —

(i)	a water supply system via a bib tap; and
(ii)	a stable electricity supply (230±10 V and 50 Hz) with an ammeter;

(b)

the water supply must have a delivery flow of at least 20 litres per minute at a dynamic pressure of 3 bars;

(c)

the bib tap must be securely connected to the high pressure washer with an inlet hose having an internal diameter of at least 15 mm;

(d)

the bib tap must be fully opened;

(e)

the flow meter and pressure gauge must be connected to the outlet hose of the high pressure washer;

(f)

the pressure setting of the high pressure washer must be set at maximum;

(g)

the flow rate, water pressure and electric current must be measured and recorded.”.

Amendment of Part 2 of Second Schedule

10. Part 2 of the Second Schedule to the principal Regulations is amended —

(a)

by inserting, immediately after sub‑paragraph (e) of paragraph 2, the following sub‑paragraph:

“(ea)

water‑closet flush valves —

”;

(b)

by inserting, immediately after the words “URINAL FLUSH VALVES” in the heading of Label 1 in paragraph 3, the words “, WATER‑CLOSET FLUSH VALVES”; and

(c)

by deleting the words “or urinal flush valve or waterless urinal” in the definition of “flush volume” in paragraph 4 and substituting the words “, urinal flush valve, water‑closet flush valve or waterless urinal”.

Amendment of Part 3 of Second Schedule

11. Part 3 of the Second Schedule to the principal Regulations is amended —

(a)

by deleting the words “or flush valve serving a urinal” in paragraph 2 and substituting the words “, urinal flush valve or water‑closet flush valve”;

(b)

by inserting, immediately after the words “paragraph 18(1)” in paragraph 2, “, (2)”;

(c)

by inserting, immediately after paragraph 3, the following paragraph:

“3A. Every washer extractor that is a specified water fitting must be of such a design as to use not more than 8 litres of water per kilogram of wash load.”;

(d)

by inserting, immediately after paragraph 4, the following paragraphs:

“4A. Every dishwasher that is a specified water fitting (other than for household use) must be of such a design as to use not more than 2.4 litres of water per rack of washware.

4B. Every high pressure washer that is a specified water fitting must be of such a design as to use not more than 11 litres of water per minute.”; and

(e)

by deleting the words “that flows out of a tap and mixer per minute” in the definition of “flow rate” in paragraph 5 and substituting the words “(measured in litres per minute) that flows out of a tap and mixer or a high pressure washer (as the case may be)”.

Amendment of Third Schedule

12. The Third Schedule to the principal Regulations is amended —

(a)

by deleting the Schedule reference and substituting the following Schedule reference:

“Regulations 34A, 36(15) and 38(5)”;

(b)

by deleting item 1 and substituting the following item:

“1. The fees for the purposes of these Regulations are as follows:

(1)	For connecting any premises to a water main belonging to or under the management or control of the Board —

(a)	where the connection is made for the purpose of supplying potable water to premises that are privately owned, and the connecting pipe used to make the connection has a diameter of —

(i)

35 mm

(ii)

100 mm

(iii)

(b)	in any other case

the costs incurred by the Board to connect the premises to the water main.

(2)	For resuming the supply of water to any premises under section 37(2) of the Act —
