Fire Safety
(Petroleum and Flammable Materials —
Exemption) (Amendment) Order 2023
In exercise of the powers conferred by section 103 of the Fire Safety Act 1993, the Minister for Home Affairs makes the following Order:
Citation and commencement
1.—(1)  This Order is the Fire Safety (Petroleum and Flammable Materials — Exemption) (Amendment) Order 2023 and, except for paragraph 5, comes into operation on 21 August 2023.
(2)  Paragraph 5 is deemed to have come into operation on 31 December 2021.
Amendment of paragraph 2
2.  In the Fire Safety (Petroleum and Flammable Materials — Exemption) Order (O 4) (called in this Order the principal Order), in paragraph 2(1), after the definition of “restaurant”, insert —
“ “scheduled chemical” has the meaning given by regulation 2(1) of the Fire Safety (Petroleum and Flammable Materials) Regulations;”.
Amendment of paragraph 4
3.  In the principal Order, in paragraph 4(2) —
(a)replace “Notwithstanding paragraph (1)” with “Despite sub‑paragraph (1)”; and
(b)after “Fire Safety (Petroleum and Flammable Materials) Regulations”, insert “, but only if it does not contain any scheduled chemical”.
Amendment of paragraph 6
4.  In the principal Order, in paragraph 6, after “Fire Safety (Petroleum and Flammable Materials) Regulations”, insert “, but only if it does not contain any scheduled chemical”.
Miscellaneous amendments
5.  In the principal Order —
(a)in paragraph 2(1), in the definition of “factory”, replace “(Cap. 354A)” with “2006”;
(b)in the following provisions, replace “section 35” with “section 78”:

Paragraph 5
Paragraph 6
Paragraph 7; and
(c)in paragraph 7, replace “section 36(a) and (b)” with “section 81(a) and (b)”.
