Rules of Court (R 5)
(Amendment) Rules 2022
In exercise of the powers conferred by section 80 of the Supreme Court of Judicature Act 1969 and all other powers enabling us under any written law, we, the Rules Committee, make the following Rules:
Citation and commencement
1.  These Rules are the Rules of Court (R 5) (Amendment) Rules 2022 and come into operation on 26 March 2022.
Amendment of Order 2
2.  In Order 2 of the Rules of Court (R 5) —
(a)in the Order heading, after “NON‑COMPLIANCE”, insert “, ETC.”; and
(b)after Rule 2, insert —
Court’s powers in interests of justice (O. 2, r. 3)
3.—(1)  Unless the context otherwise requires and subject to any other written law, all requirements in these Rules are subject to the Court’s discretion to order otherwise in the interests of justice, even if they are expressed using imperative words such as “must”, “is to” or “shall”.
(2)  Unless these Rules or other written law otherwise provides, the Court may do whatever the Court considers necessary on the facts of the case before it to ensure that justice is done or to prevent an abuse of the process of the Court, so long as it is not prohibited by law.”.
