(Motor Vehicles, Registration and Licensing)
(Amendment No. 3) Rules 2022

In exercise of the powers conferred by sections 34 and 140 of the Road Traffic Act 1961, the Minister for Transport makes the following Rules:

Citation and commencement

1. These Rules are the Road Traffic (Motor Vehicles, Registration and Licensing) (Amendment No. 3) Rules 2022 and come into operation on 15 September 2022.

Amendment of rule 8

2. In rule 8 of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5) (called in these Rules the principal Rules) —

(a)

in paragraph (7)(e), after “rule 9A,”, insert “9AB,”;

(b)

in paragraph (7)(e), insert “or” at the end;

(c)

in paragraph (7), delete sub-paragraph (f);

(d)

in paragraph (15)(c), replace sub‑paragraphs (i) and (ii) with —

“(i)	in the case of a taxi which was not a specified taxi — was not more than 8 years old; or
(ii)	in the case of a specified taxi, or a vehicle which was not a taxi — was not more than 10 years old;”;

(e)

in paragraph (15A)(b), replace sub‑paragraphs (i) and (ii) with —

“(i)	in the case of a taxi which was not a specified taxi — was not more than 8 years old; or
(ii)	in the case of a specified taxi, or a vehicle which was not a taxi — was not more than 10 years old;”; and

(f)

after paragraph (15A), insert —

“(16) In paragraphs (15)(c) and (15A)(b), a specified taxi is a taxi which —

(a)	is an electric car registered on or after 15 September 2022; or
(b)	is an electric car registered before 15 September 2022 and the certificate of entitlement for that taxi has been extended under rule 24BA of the Road Traffic (Motor Vehicles, Quota System) Rules (R 31).”.

Amendment of rule 39

3. In rule 39 of the principal Rules —

(a)

in paragraph (1)(e), replace sub‑paragraphs (i) and (ii) with —

“(i)	in a case where the taxi licence is issued before 1 September 2003 — is more than 7 years old on that date;
(ii)	in a case where the taxi licence is issued for a taxi which is not a specified taxi — is more than 8 years old on that date; or
(iii)	in a case where the taxi licence is issued for a taxi which is a specified taxi — is more than 10 years old on that date;”; and

(b)

after paragraph (1), insert —

“(2) In paragraph (1)(e), “specified taxi” has the meaning given by rule 8(16).”.

Amendment of First Schedule

4. In the First Schedule to the principal Rules —

(a)

delete Part VIII; and

(b)

replace Part IX with —

“Part ix

(3)	Exceeding 6 years but not exceeding 7 years

(4)	Exceeding 7 years but not exceeding 8 years

(5)	Exceeding 8 years

Nil

Rebate for de‑registration of
old vehicles which are specified taxis

Age of old vehicle at the time of its de‑registration

Amount of rebate allowable, expressed as a percentage of the relevant additional registration fee as determined under rule 8(8)

(1)	Not exceeding 5 years

75%

(2)	Exceeding 5 years but not exceeding 6 years

70%

(3)	Exceeding 6 years but not exceeding 7 years

65%

(4)	Exceeding 7 years but not exceeding 8 years

60%

(5)	Exceeding 8 years but not exceeding 9 years

55%

(6)	Exceeding 9 years but not exceeding 10 years

50%

(7)	Exceeding 10 years

Nil

Note: In this Part, “specified taxi” has the meaning given by rule 8(16).”.
