Misuse of Drugs
(Amendment No. 2) Regulations 2023

In exercise of the powers conferred by section 58 of the Misuse of Drugs Act 1973, the Minister for Home Affairs makes the following Regulations:

Citation and commencement

1. These Regulations are the Misuse of Drugs (Amendment No. 2) Regulations 2023 and come into operation on 1 July 2023.

Amendment of Fourth Schedule

2. In the Misuse of Drugs Regulations (Rg 1), in the Fourth Schedule —

(a)

in paragraph 1, in item (6), after “derivatives”, insert “as defined in Part 4 of the First Schedule to the Act”;

(b)

in paragraph 15, in item (c), after “alkyl”, insert “, cycloalkyl”;

(c)

in paragraph 15, after item (1), insert —

“(1AAA)

1-(1,3-Benzodioxol-5-yl)-2-(cyclohexylamino)propan-1-one (also known as 3,4-methylenedioxy-N-cyclohexylcathinone or 3,4-methylenedioxy-α-cyclohexylaminopropiophenone or N‑cyclohexylmethylone or Cyputylone)”;

(d)

(i)

in paragraph 17, after item (6H), insert —

2-(2-(4-Butoxybenzyl)-5-nitro-1H-benzo[d]imidazol-1-yl)-N,N-diethylethan-1-amine (also known as butonitazene or butoxynitazene) and its diethylamino and butoxy structural isomers and their respective butoxy positional isomers in the phenyl ring and nitro positional isomers in the 6‑membered ring of the benzimidazole structure”;

(j)

in paragraph 17, after item (8AB), insert —

5-(Cyclobutylmethyl)-2-(2-phenylpropan-2-yl)-pyrido[4,3-b]indol-1-one (also known as Cumyl-CB-MeGACLONE, Cumyl-CBMGACLONE, cumyl-cyclobutylmethyl-gammacarbolinone or SGT‑273) and its phenylpropyl isomers”;

(k)

in paragraph 17, after item (8B), insert —

N-Cyclohexyl-2-(1-(4-hydroxypentyl)-1H-indol-3-yl)acetamide and its hydroxy positional isomers in the pentyl group

in paragraph 17, after item (10D), insert —

(n)

in paragraph 17, after item (22A), insert —

N’-(1-Hexyl-2-oxoindolin-3-ylidene)-4-hydroxybenzohydrazide and its hydroxy positional isomers in the phenyl ring”;

(o)

in paragraph 17, after item (25), insert —

N’-(1-(4-Hydroxycyclohexylmethyl)-2-oxoindolin-3-ylidene)benzohydrazide and its hydroxy positional isomers in the cyclohexyl group”;

(p)

in paragraph 17, after item (31), insert —

1-(2-Methyl-4-(3-phenyl-prop-2-en-1-yl)-piperazin-1-yl)-1-butanone (also known as 2-methyl-AP-237 or 2‑methyl buccinazine) and its methyl positional isomers in the piperazinyl ring”; and

(q)

in the following provisions, replace “alkyl phenyl” with “arylalkyl”:
