(Composition of Offences)
(Amendment) Regulations 2024

In exercise of the powers conferred by section 57 of the Charities Act 1994, the Minister for Culture, Community and Youth makes the following Regulations:

Citation and commencement

1.—(1) These Regulations are the Charities (Composition of Offences) (Amendment) Regulations 2024 and, except for regulation 2(a) and (b), come into operation on 1 March 2024.

(2) Regulation 2(a) and (b) is deemed to have come into operation on 31 December 2021.

Amendment of regulation 2

2. In the Charities (Composition of Offences) Regulations (Rg 7), in regulation 2 —

(a)

replace “section 47(1)” with “section 55(1)”;

(b)

in paragraph (a), replace “section 5(6), 8(3) or (8), 14(5), 18, 25(12), 28(1), 39A(2), 39B(2) or 41A(7)” with “section 7(8), 10(3) or (8), 16, 23(20), 29(1), 36(2), 37(5) or 44(8)”;

(c)

in paragraph (f), delete “and” at the end; and

(d)

replace paragraph (g) with —

“(g)	an offence under regulation 4(3), (4) or (5), 5(8) or (9), 6(3), 7(3), 11(3), 14(7), 15(3), 15A(3) or (4), 16(4) or (6), 17(7), 19(1), 20(1), 20C(3) or (4), 20D(3), (4) or (5), 20E(3), 20F(3), (4) or (5), 23(2), 25(3), 26(6) or 27(1) of the Charities (Fund‑raising Appeals for Local and Foreign Charitable Purposes) Regulations 2012 (G.N. No. S 530/2012);
(h)	an offence under regulation 21(1) or (2) of the Charities (Institutions of A Public Character) Regulations (Rg 5).”.
