(No. 2) Regulations 2023

In exercise of the powers conferred by section 57 of the Charities Act 1994, the Minister for Culture, Community and Youth makes the following Regulations:

Citation and commencement

1. These Regulations are the Charities (Miscellaneous Amendments) (No. 2) Regulations 2023 and are deemed to have come into operation on 31 December 2021.

Amendment of Charities (Large Charities) Regulations

2. In the Charities (Large Charities) Regulations (Rg 9), in regulation 2 —

(a)	in the definition of “institution of a public character”, replace “section 40A” with “section 40”; and
(b)	in the definition of “Sector Administrator”, in paragraph (a), replace “section 40B” with “section 41”.

Amendment of Charities (Registration of Charities) Regulations

3. In the Charities (Registration of Charities) Regulations (Rg 10) —

(a)	in regulation 2, in the definition of “Sector Administrator”, in paragraphs (a)(i) and (b)(i), replace “section 40B” with “section 41”;
(b)	in regulation 4(4)(b), replace “(Cap. 50)” with “1967”; and
(c)	in regulation 6(1)(a), replace “section 5(3)” with “section 7(3)”.

Amendment of Charities (Exemption from section 39A) Regulations 2011

4. In the Charities (Exemption from section 39A) Regulations 2011 (G.N. No. S 487/2011) —

(a)	in regulation 1, replace “(Exemption from section 39A)” with “(Exemption from Permit for Fund‑raising Appeal)”;
(b)	in regulation 2, in the regulation heading, replace “section 39A” with “section 36”;
(c)	in regulation 2(1), replace “section 39A” with “section 36”;
(d)	in regulation 2(3)(a), replace “(Cap. 50)” with “1967”; and
(e)	in regulation 2(3)(b), replace “(Cap. 311)” with “1966”.

Amendment of Charities (Electronic Transactions Service) Regulations 2019

5. In the Charities (Electronic Transactions Service) Regulations 2019 (G.N. No. S 243/2019), in regulation 8(1)(d), replace “(Cap. 97)” with “1893”.
