(Amendment No. 5) Rules 2013

In exercise of the powers conferred by sections 34 and 140 of the Road Traffic Act, the Minister for Transport hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Road Traffic (Motor Vehicles, Registration and Licensing) (Amendment No. 5) Rules 2013 and shall come into operation on 19th May 2013.

Amendment of rule 36

2. Rule 36 of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5) (referred to in these Rules as the principal Rules) is amended —

(a)

by inserting, immediately after the words “(both dates inclusive)” in paragraph (4A)(b), the words “or between 1st July 2013 and 30th June 2014 (both dates inclusive)”; and

(b)

by inserting, immediately after paragraph (4A), the following paragraph:

“(4B) Where a licence referred to in paragraph (4A) commences on any date before 1st July 2013 but the period for which the licence is taken out falls partly in the period between 1st July 2013 and 30th June 2014 (both dates inclusive), the fee payable for the licence shall be the sum of the following:

(a)	the appropriate fee specified in the Twelfth Schedule calculated on a pro-rata basis for the period of the licence ending on 30th June 2013; and
(b)	the appropriate fee specified in the Fourteenth Schedule calculated on a pro-rata basis for the remaining period of the licence.”.

Amendment of rule 36C

3. Rule 36C of the principal Rules is amended by deleting paragraph (2) and substituting the following paragraphs:

“(2) Notwithstanding paragraph (1), the appropriate fee specified in the Fourteenth Schedule shall be payable for a licence referred to in that paragraph that commences on any date —

(a)	between 1st July 2009 and 30th June 2010 (both dates inclusive); or
(b)	between 1st July 2013 and 30th June 2014 (both dates inclusive).

(3) Where a licence referred to in paragraph (1) commences on any date before 1st July 2013 but the period for which the licence is taken out falls partly in the period between 1st July 2013 and 30th June 2014 (both dates inclusive), the fee payable for the licence shall be the sum of the following:

(a)	the appropriate fee specified in the Twelfth Schedule calculated on a pro-rata basis for the period of the licence ending on 30th June 2013; and
(b)	the appropriate fee specified in the Fourteenth Schedule calculated on a pro-rata basis for the remaining period of the licence.”.

Amendment of rule 37

4. Rule 37 of the principal Rules is amended —

(a)	by deleting the words “rule 36(4), (5), (6), (7)” in paragraph (1) and substituting the words “rule 36(4), (4A), (4B), (5), (6), (7), 36C”; and
(b)	by inserting, immediately after the word “rule 36(4)” in paragraph (5)(a), the words “, (4A) or (4B) or 36C”.

Amendment of Fourteenth Schedule

5. The heading to the Fourteenth Schedule to the principal Rules is amended by inserting, immediately after the words “(BOTH DATES INCLUSIVE)”, the words “OR BETWEEN 1ST JULY 2013 AND 30TH JUNE 2014 (BOTH DATES INCLUSIVE).”.

Transitional provisions

6. Where a licence under rule 36 or 36C is issued before 19th May 2013 and the period for which the licence is taken out falls partly in the period between 1st July 2013 and 30th June 2014, the holder of the licence shall be granted a rebate by the Registrar of an amount equivalent to the amount by which the licence fee paid by the holder exceeds the licence fee which would have been payable if these Rules were in force when the licence was issued.
