Plant Varieties Protection
(Amendment) Rules 2021
In exercise of the powers conferred by section 54 of the Plant Varieties Protection Act, the Minister for Law makes the following Rules:
Citation and commencement
1.  These Rules are the Plant Varieties Protection (Amendment) Rules 2021 and come into operation on 1 October 2021.
Amendment of rule 8
2.  Rule 8(1) of the Plant Varieties Protection Rules (R 1) (called in these Rules the principal Rules) is amended by deleting the words “of business of the person or partnership or association of persons or body corporate, whose address is furnished” and substituting the words “indicated by the address”.
Amendment of rule 62
3.  Rule 62 of the principal Rules is amended by deleting paragraph (1) and substituting the following paragraphs:
(1)  Where the Registrar has awarded party and party costs to a party to proceedings before the Registrar and the party wishes to have the costs taxed by the Registrar, the party must, within 6 weeks after the relevant date mentioned in paragraph (1A) —
(a)apply for the costs to be taxed by filing a copy of the bill of costs with the Registrar; and
(b)send at the same time a copy of the bill of costs to every other person having an interest in the taxation proceedings.
(1A)  For the purposes of paragraph (1), the relevant date is —
(a)subject to sub-paragraph (b), the date of the award for costs made by the Registrar; or
(b)where any appeal is brought in respect of that award for costs, the date on which the appeal is finally disposed of.”.
Deletion and substitution of rule 65
4.  Rule 65 of the principal Rules is deleted and the following rule substituted therefor:
Certificate of taxation
65.  When a bill of costs has been taxed, the Registrar must make the Registrar’s certificate for the amount of the taxed costs.”.
Amendment of Second Schedule
5.  The Second Schedule to the principal Rules is amended by deleting the items relating to Form Nos. PVP-TQ, PVP 5 and PVP 19.
Amendment of Fifth Schedule
6.  Item 11 of the Fifth Schedule to the principal Rules is amended by deleting the words “and obtaining the Registrar’s certificate or order”.
Saving and transitional provision
7.  Despite rule 3, rule 62(1) of the principal Rules as in force immediately before 1 October 2021 continues to apply to or in relation to any award of costs made before that date by the Registrar.
