Management (Vehicular Emissions)
(Amendment No. 3) Regulations 2023
In exercise of the powers conferred by sections 12(5) and 77 of the Environmental Protection and Management Act 1999, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:
Citation and commencement
1.  These Regulations are the Environmental Protection and Management (Vehicular Emissions) (Amendment No. 3) Regulations 2023 and come into operation on 1 January 2024.
Amendment of regulation 4
2.  In the Environmental Protection and Management (Vehicular Emissions) Regulations (Rg 6) (called in these Regulations the principal Regulations), in regulation 4(1) and (2), replace “1 April 2023” with “1 January 2024”.
Amendment of First Schedule
3.  In the principal Regulations, in the First Schedule —
(a)in paragraph 1(a), replace sub‑paragraphs (ii) and (iii) with —
“(ii)JPN2018 and Euro 6 PN limit; or
(iii)JPN2023”;
(b)in paragraph 1(b), replace sub‑paragraphs (ii) and (iii) with —
“(ii)JPN2018; or
(iii)JPN2023”;
(c)in paragraph 1(c), replace sub‑paragraphs (i) and (ii) with —
“(i)Euro 6 standard;
(ii)JPN2018 and Euro 6 PN limit; or
(iii)JPN2023”;
(d)in paragraph 1(d), replace sub‑paragraphs (i) and (ii) with —
“(i)Euro 6 standard;
(ii)JPN2018; or
(iii)JPN2023”;
(e)in paragraph 2, replace the definition of “Euro 6 PN limit” with —
“ “Euro 6 PN limit” means the standard for particle numbers in exhaust emission specified in the column titled “Number of particles (PN)” in Regulation (EC) No. 715/2007, Annex I, Table 2, as amended by Commission Regulation (EU) No. 459/2012 and read with Commission Regulation (EU) No. 2017/1151;”;
(f)in paragraph 2, delete the definitions of “Euro 6 PN limit (WLTP)”, “Euro 6 standard (WLTP)” and “JPN2009”;
(g)in paragraph 2, replace the definition of “Euro 6 standard” with —
“ “Euro 6 standard” means the standard for exhaust emissions in Regulation (EC) No. 715/2007, Annex I, Table 2, as amended by Commission Regulation (EU) No. 459/2012 and read with Commission Regulation (EU) No. 2017/1151;”;
(h)in paragraph 2, in the definition of “JPN2018”, replace “paragraph 1(3)B” with “paragraph 1(3)”; and
(i)in paragraph 2, after the definition of “JPN2018”, insert —
“ “JPN2023” means paragraph 1(3) of Article 41 of the Japanese Ministry of Land, Infrastructure and Transport Announcement No. 619 dated 15 July 2002 (ANNOUNCEMENT THAT PRESCRIBES DETAILS OF SAFETY REGULATIONS FOR ROAD VEHICLES), as amended by the Japanese Ministry of Land, Infrastructure, Transport and Tourism Announcement No. 1040 dated 7 October 2022;”.
Amendment of Second Schedule
4.  In the principal Regulations, in the Second Schedule —
(a)in paragraph 1(a), replace sub‑paragraphs (ii) and (iii) with —
“(ii)JPN2018 and Euro 6 PN limit; or
(iii)JPN2023”;
(b)in paragraph 1(b), replace sub‑paragraphs (i) and (ii) with —
“(i)Euro 6 standard for light vehicles;
(ii)JPN2018 and Euro 6 PN limit; or
(iii)JPN2023”;
(c)in paragraph 1(c), replace sub‑paragraphs (ii) and (iii) with —
“(ii)PPNLT and Euro VI PM number;
(iii)PPNLT (Alternate) and Euro VI PM number (Alternate);
(iv)PPNLT 2023; or
(v)PPNLT 2023 (Alternate)”;
(d)in paragraph 2, replace the definition of “Euro 6 PN limit” with —
“ “Euro 6 PN limit” means the standard for particle numbers in exhaust emission specified in the column titled “Number of particles (PN)” in Regulation (EC) No. 715/2007, Annex I, Table 2, as amended by Commission Regulation (EU) No. 459/2012 and read with Commission Regulation (EU) No. 2017/1151;”;
(e)in paragraph 2, delete the definitions of “Euro 6 PN limit (WLTP)”, “Euro 6 standard for light vehicles (WLTP)” and “JPN2009”;
(f)in paragraph 2, replace the definition of “Euro 6 standard for light vehicles” with —
“ “Euro 6 standard for light vehicles” means the standard for exhaust emissions in Regulation (EC) No. 715/2007, Annex I, Table 2, as amended by Commission Regulation (EU) No. 459/2012 and read with Commission Regulation (EU) No. 2017/1151;”;
(g)in paragraph 2, in the definition of “JPN2018”, replace “paragraph 1(7)B” with “paragraph 1(7)”;
(h)in paragraph 2, after the definition of “JPN2018”, insert —
“ “JPN2023” means paragraph 1(7) of Article 41 of the Japanese Ministry of Land, Infrastructure and Transport Announcement No. 619 dated 15 July 2002 (ANNOUNCEMENT THAT PRESCRIBES DETAILS OF SAFETY REGULATIONS FOR ROAD VEHICLES), as amended by the Japanese Ministry of Land, Infrastructure, Transport and Tourism Announcement No. 1040 dated 7 October 2022;”; and
(i)in paragraph 2, after the definition of “PPNLT (Alternate)”, insert —
“ “PPNLT 2023” means the emission standards known as the Post‑Post New Long Term emission regulations that are set out in paragraph 1(5) titled “[JE05‑Mode Mean Value Regulations at Time of Completion Inspection, etc. for Diesel Motor Vehicles (with GVW exceeding 3.5 tons)]” of Article 41 of the Japanese Ministry of Land, Infrastructure and Transport Announcement No. 619 dated 15 July 2002 (ANNOUNCEMENT THAT PRESCRIBES DETAILS OF SAFETY REGULATIONS FOR ROAD VEHICLES), as amended by the Japanese Ministry of Land, Infrastructure, Transport and Tourism Announcement No. 1 dated 4 January 2023;
“PPNLT 2023 (Alternate)” means the emission standards known as the Post‑Post New Long Term emission regulations that are set out in paragraph 1(5) titled “[JE05‑Mode Mean Value Regulations at Time of Completion Inspection, etc. for Diesel Motor Vehicles (with GVW exceeding 3.5 tons)]” of Article 41 of the Japanese Ministry of Land, Infrastructure and Transport Announcement No. 619 dated 15 July 2002 (ANNOUNCEMENT THAT PRESCRIBES DETAILS OF SAFETY REGULATIONS FOR ROAD VEHICLES), as amended by the Japanese Ministry of Land, Infrastructure, Transport and Tourism Announcement No. 1 dated 4 January 2023, with the exhaust emission determined in accordance with the test method set out in the document titled “Measurement Procedure for JE05‑Mode Exhaust Emissions by Means of Chassis Dynamometer” and “Measurement Procedure for WHTC Exhaust Emissions by Means of Chassis Dynamometer”, Kokujikan No. 280 of 16 March 2007 as amended by Kokujikan No. 68 of 1 July 2011 and Kokujikan No. 91 of 30 August 2017, Attachment 2;”.
