Control of Plants Act
(Chapter 57A)
Control of Plants (Cultivation of Plants) (Licensing and Certification) (Amendment) Rules 1999
In exercise of the powers conferred by section 46 of the Control of Plants Act, the Minister for National Development hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Control of Plants (Cultivation of Plants) (Licensing and Certification) (Amendment) Rules 1999 and shall come into operation on 8th January 1999.
Amendment of rule 2
2.  Rule 2 of the Control of Plants (Cultivation of Plants) (Licensing and Certification) Rules (R 2) (referred to in these Rules as the principal Rules) is amended —
(a)by deleting the definitions of "licence" and "licensee" and substituting the following definitions:
“ “licence” means a licence issued by the Director under section 30 of the Act for the cultivation of plants;
“licensee” means the holder of a licence;”; and
(b)by deleting the word "prohibited" in the definition of "prohibited pesticide" and substituting the word "unregistered".
Deletion of rules 4 to 7 and substitution of rules 4, 5 and 6
3.  Rules 4 to 7 of the principal Rules are deleted and the following rules substituted therefor:
Fees for licence and renewal of licence
4.  Every application for a licence and every application for the renewal of a licence shall be accompanied by the appropriate fee specified in the First Schedule.
Director may inspect premises
5.—(1)  Upon receiving an application for a licence, the Director may inspect the premises which the applicant intends to use for the cultivation of plants.
(2)  If the Director is satisfied that the premises are suitable for such use, he may issue a licence to the applicant.
Renewal of licence
6.  Every application for the renewal of a licence may be made at any time during one month immediately preceding its expiry.”.
Deletion and substitution of rule 12
4.  Rule 12 of the principal Rules is deleted and the following rule substituted therefor:
Revoked or suspended licence to be surrendered
12.—(1)  A licensee shall, upon the receipt of a notice, referred to in section 31(3) of the Act, of the revocation or suspension of his licence, forthwith surrender his licence to the Director.
(2)  The Director shall, upon the expiry of the period of suspension of a licence which has been surrendered to him under paragraph (1), return the licence to the person to whom the licence was issued if the licence has not at that time expired.”.
Amendment of rule 23
5.  Rule 23 of the principal Rules is amended —
(a)by deleting the words "a Scientific Officer" in the 17th line of paragraph (3) and substituting the words "an authorised analyst"; and
(b)by deleting paragraph (8).
Amendment of rule 26
6.  Rule 26 of the principal Rules is amended by deleting "12 (3)" and substituting "12 (1)".
Amendment of First Schedule
7.  The First Schedule to the principal Rules is amended by inserting, immediately after "$100" in item 1, the words "per annum".
Miscellaneous amendments
8.  The principal Rules are amended by deleting the words "prohibited pesticide" wherever they appear in the following provisions and substituting in each case the words "unregistered pesticide":
Rules 21(1) (f) (i), 22, 23(1) (4th line), (3) (19th line), (6) (3rd line) and (7) (3rd line) and 24(1) (b).
