COVID-19 (Temporary Measures)
(Business Events — Control Order)
(Amendment No. 8) Regulations 2021
In exercise of the powers conferred by section 34(1) of the COVID‑19 (Temporary Measures) Act 2020, the Minister for Health makes the following Regulations:
Citation and commencement
1.  These Regulations are the COVID‑19 (Temporary Measures) (Business Events — Control Order) (Amendment No. 8) Regulations 2021 and come into operation on 10 November 2021.
Amendment of regulation 4
2.  Regulation 4 of the COVID‑19 (Temporary Measures) (Business Events — Control Order) Regulations 2021 (G.N. No. S 278/2021) (called in these Regulations the principal Regulations) is amended —
(a)by inserting, immediately after the words “such a business event,” in paragraph (1A), the words “every participant is allotted into a cohort and”;
(b)by deleting “2” in paragraph (1A); and
(c)by inserting, immediately after paragraph (2), the following paragraph:
(3)  In paragraph (1A), a cohort of participants of a business event means as follows:
(a)a cohort consisting of not more than 2 participants of the business event unless sub‑paragraph (b), (c), (d), (e) or (f) applies;
(b)where the venue of the business event is a community eating place and any food or drink is or is to be consumed in connection with the business event, a cohort consisting of —
(i)2 individuals in total each with a cleared status;
(ii)2 individuals in total, consisting of one uncleared junior and one other individual with a cleared status; or
(iii)2 uncleared juniors all from the same household;
(c)where the venue of the business event is any other retail food and drinks establishment and any food or drink is or is to be consumed in connection with the business event, a cohort consisting of —
(i)2 individuals in total each with a cleared status;
(ii)2 individuals in total, consisting of one uncleared junior and one other individual with a cleared status; or
(iii)5 or fewer individuals in total, all of whom are from the same household and consisting of —
(A)uncleared juniors only;
(B)individuals each with a cleared status; or
(C)a mix of uncleared juniors and other individuals each with a cleared status;
(d)where the venue of the business event is a place at which a retail liquor business is for the time being carried on and any food or drink is or is to be consumed in connection with the business event — 2 individuals each with a cleared status;
(e)where the venue of the business event is an indoor physical recreational facility and any high‑intensity physical exercise or other sporting activity or physical recreational activity without wearing a mask is or is to be engaged in at the business event — a sporting activity cohort;
(f)where any personal appearance service or personal care service that requires taking off, or not wearing, one’s mask in order to receive the service is or is to be engaged in at the business event — a personalised service cohort.”.
Amendment of regulation 6
3.  Regulation 6 of the principal Regulations is amended —
(a)by deleting “50” in paragraphs (1)(a) and (2)(a) and substituting in each case “100”; and
(b)by deleting “3” in paragraphs (1)(b)(ii) and (2)(b)(ii) and substituting in each case “2”.
Amendment of regulation 9A
4.  Regulation 9A of the principal Regulations is amended —
(a)by inserting, immediately after the words “to ensure” in paragraph (2), the words “that the requirements in the Main Control Order are complied with, subject to”;
(b)by deleting sub‑paragraphs (d) and (e) of paragraph (2) and substituting the following sub‑paragraphs:
(d)paragraph 2(a) of Part 3 of the First Schedule to the Main Control Order, and paragraph 1(1)(a) or 4(a) (as the case may be) of Part 4 of the First Schedule to the Main Control Order, being disapplied in relation to the business event; and
(e)paragraph 1(1)(b) and (c) and (2)(a) of Part 4 of the First Schedule to the Main Control Order applying despite any general physical distancing requirement in these Regulations.”;
(c)by inserting, immediately after paragraph (2), the following paragraph:
(2A)  Where the consumption of any food or drink in connection with a business event in regulation 15A or 15D is not prohibited by any Control Order, and is or is to be engaged in at the business event, the prevailing rule requirement also means that —
(a)the food or drink must not be served or consumed in the venue of the business event when a live performance, or a lecture, a talk or an address or other sound which is not pre‑recorded, is taking place or is displayed, exhibited or played in the venue;
(b)the food or drink must be served in connection with the business event only in individual servings, and in no other way; and
(c)the food or drink must be consumed in connection with the business event only when participants are and remain seated as if a dining‑in activity cohort.”; and
(d)by deleting “(2)” in paragraph (3) and substituting “(2A)”.
Amendment of regulation 15C
5.  Regulation 15C of the principal Regulations is amended by deleting paragraph (2) and substituting the following paragraph:
(2)  In addition, an organiser of a business event must take all reasonably practicable measures to ensure that at all times during the crowd management period of the business event —
(a)every participant and non-participant in the venue where the business event is taking place is each wearing a mask if the participant or non‑participant (as the case may be) is not authorised under any Control Order to not wear a mask or he or she does not have a reasonable excuse to be unmasked; and
(b)the number of individuals who are unmasked in the venue where the business event is taking place does not exceed the maximum number permissible under the COVID‑19 (Temporary Measures) (Performances and Other Activities — Control Order) Regulations 2020 for individuals engaged in public speaking or who are performers in the live performance, if these elements are present during the business event.”.
Amendment of regulation 15F
6.  Regulation 15F of the principal Regulations is amended by deleting paragraph (2) and substituting the following paragraph:
(2)  In addition, an organiser of a business event must take all reasonably practicable measures to ensure that at all times during the crowd management period of the business event —
