Road Traffic (Exemption from Section 12 — Approval) (Amendment) Rules 2007
In exercise of the powers conferred by section 140 of the Road Traffic Act, the Minister for Transport hereby makes the following Rules:
Citation and commencement
1.—(1)  These Rules may be cited as the Road Traffic (Exemption from Section 12 — Approval) (Amendment) Rules 2007 and shall, with the exception of rules 2 and 3, come into operation on 6th July 2007.
(2)  Rules 2 and 3 shall be deemed to have come into operation on 28th June 2006.
Amendment of rule 3
2.  Rule 3(2) of the Road Traffic (Exemption from Section 12 –– Approval) Rules 2005 (G.N. No. S 721/2005) (referred to in these Rules as the principal Rules) is amended —
(a)by deleting sub-paragraph (d) and substituting the following sub-paragraph:
(d)the person or his spouse is the registered owner of the vehicle, or the person’s employer is the registered owner of the vehicle and has provided the person with the vehicle, or the person’s employer has hired the vehicle for use by the person alone;”; and
(b)by inserting, immediately after the words “28 other days” in sub-paragraph (g)(ii) and (iii), the words “(or such greater number of days as the Registrar allowed)”.
New rule 3A
3.  The principal Rules are amended by inserting, immediately after rule 3, the following rule:
Application by spouse of citizen or permanent resident of Singapore
3A.—(1)  Where a person is granted or has applied for approval under rule 3 in respect of a vehicle, his spouse may apply to the Registrar for approval to rely on the exemption under paragraph 3(1A) of the Road Traffic (Exemption from Section 12) Order 2005 (G.N. No. S 722/2005) in respect of the vehicle.
(2)  The Registrar may grant the approval if the Registrar has determined, on the basis of information furnished by the person and his spouse and of records determined by the Registrar, that the following conditions are satisfied:
(a)the spouse is a citizen or permanent resident of Singapore, and resides in Malaysia; and
(b)the person, the spouse or the person’s employer is the registered owner of the vehicle.”.
Amendment of rule 4
4.  Rule 4(2) of the principal Rules is amended —
(a)by inserting, immediately after the words “permanent resident of Malaysia” in sub-paragraph (c), the words “who is not also a citizen or permanent resident of Singapore”; and
(b)by inserting, immediately after the words “28 other days” in sub-paragraph (g)(ii) and (iii), the words “(or such greater number of days as the Registrar allowed)”.
Amendment of rule 5
5.  Rule 5 of the principal Rules is amended by inserting, immediately after paragraph (2), the following paragraph:
(2A)  An approval under rule 3A shall cease to be valid if the person and his spouse are divorced.”.
Amendment of rule 6
6.  Rule 6 of the principal Rules is amended —
(a)by inserting, immediately after paragraph (1), the following paragraph:
(1A)  Where an approval under rule 3A ceases to be valid under rule 5 (2A), the person who was granted an approval under rule 3 shall within one month of the divorce notify the Registrar of that fact.”; and
(a)by inserting, immediately after the words “paragraph (1)” in paragraph (2), the words “or (1A) without reasonable excuse”.
Transitional and savings provision
7.—(1)  Rule 4 of the principal Rules in force immediately before 6th July 2007 shall continue to apply to an application made under that rule before that date.
(2)  In applying the principal Rules to an approval granted pursuant to an application referred to in paragraph (1), a reference to rule 4 in the principal Rules shall be read as a reference to that provision in force immediately before 6th July 2007.
