Prevention of Pollution of the Sea
(Reception Facilities and Garbage Facilities)
(Amendment) Regulations 2022
In exercise of the powers conferred by section 34(1) of the Prevention of Pollution of the Sea Act 1990, the Maritime and Port Authority of Singapore, with the approval of the Minister for Transport, makes the following Regulations:
Citation and commencement
1.  These Regulations are the Prevention of Pollution of the Sea (Reception Facilities and Garbage Facilities) (Amendment) Regulations 2022 and come into operation on 1 January 2023.
Amendment of regulation 2
2.  In regulation 2 of the Prevention of Pollution of the Sea (Reception Facilities and Garbage Facilities) Regulations (Rg 4) (called in these Regulations the principal Regulations), after the definition of “garbage facilities”, insert —
“ “GST” means the goods and services tax chargeable under the Goods and Services Tax Act 1993;”.
Replacement of regulation 13 and new regulation 14
3.  In the principal Regulations, replace regulation 13 with —
Fees
13.—(1)  The fees specified in the second column of the Schedule are payable to the Authority for the services provided by the Authority specified opposite in the first column of the Schedule.
(2)  The Authority may, if it thinks fit, remit or refund any fee or part of any fee specified in the Schedule.
(3)  Where GST is chargeable on any supply of services provided by the Authority specified in the first column of the Schedule, GST is calculated based on the rate in force at the time the services are supplied.
Partial waiver in 2023 due to increase in GST
14.  In respect of the fee for any supply of services specified in the first column of the Schedule that is chargeable with GST, an amount equivalent to 1% of the fee (exclusive of GST) is waived for the period between 1 January 2023 and 31 December 2023 (both dates inclusive).”.
Amendment of Schedule
4.  In the Schedule to the principal Regulations —
(a)replace the Schedule reference with —
Regulations 13 and 14”;
(b)replace item 1 with —
 
“1.Disposal of garbage
(i)$972 (inclusive of GST) per bin or part of a bin per trip
 
 
(ii)$1,296 (inclusive of GST) for 2 bins or part of every 2 bins per trip”;
(c)in item 2(a)(ii), in the second column, replace “$450” with “$486 (inclusive of GST)”; and
(d)in item 2(b), in the second column, replace “$300” with “$324 (inclusive of GST)”.
