Citation

1. These Rules may be cited as the Road Traffic (Motor Vehicles, Speed Warning Device) Rules.

Definitions

2. In these Rules, unless the context otherwise requires —

“activation speed” means the speed of a vehicle above which the lamps and buzzer of any speed warning device of the vehicle shall flash and buzz respectively;

“authorised workshop” means a workshop authorised by the Registrar of Vehicles under rule 8 to carry out the installation, calibration and repair of the speed warning device of a vehicle;

“speed warning device” is a device consisting of any lamp, buzzer, speed sensor, transmission cable and electrical connection which together form a device that gives a visual and audio warning to the driver of the vehicle in which the device is installed that the speed of the vehicle exceeds the statutory speed limit for the vehicle as prescribed in the Road Traffic (Regulation of Speed) Rules.

Application

3.—(1) Every vehicle to which these Rules apply shall be fitted with a speed warning device of a type approved by the Registrar.

(2) These Rules shall apply to every goods vehicle having a maximum laden weight of not more than 3,000 kilogrammes.

(3) These Rules shall not apply to a trivan or motor cycle with a sidecar attached thereto.

Speed warning device

4.—(1) A speed warning device installed in a motor vehicle under these Rules shall consist of —

(a)	an amber lamp mounted on the roof of the vehicle in a position approved by the Registrar;
(b)	a lamp in front of the driver in a position clearly visible to him; and
(c)	a buzzer in front of him.

(2) The speed warning device shall be of a design approved by the Registrar.

(3) The speed warning device shall be so constructed that —

(a)

when the vehicle in which the device is installed exceeds the statutory speed limit for the vehicle as prescribed in the Road Traffic (Regulation of Speed) Rules —

(i)	the lamps mounted on the roof of the vehicle and in front of the driver each show a flashing light; and
(ii)	the buzzer produces a warning sound; and [R 13.]

(b)

when the vehicle is stationary, with its engine running the lamps mounted on the roof of the vehicle and in front of the driver are lit.

(4) The lamp mounted on the roof of the vehicle shall when it is lit be clearly visible at all times of the day to other persons using the road within a distance of 50 metres of the vehicle.

(5) All exposed electrical connections of the speed warning device shall be made of coaxial cable or of an approved design.

(6) The speed warning device shall be capable of being sealed against any unauthorised adjustment of the activation speed of the vehicle.

Works by authorised workshop

5. Any installation, calibration or repair of a speed warning device installed in a vehicle under these Rules shall be carried out by an authorised workshop.

Registrar to authorise workshops

6.—(1) The Registrar of Vehicles may authorise a workshop to —

(a)	install a speed warning device in a vehicle under these Rules;
(b)	repair and calibrate such speed warning device; and
(c)	seal the speed warning device against any unauthorised adjustment of the activation speed of the vehicle or any other tampering with the device.

(2) Any such authorisation shall be valid for a period of 6 months or one year and may be renewed at the discretion of the Registrar.

(3) Any such authorisation may be terminated by the Registrar by notice to the authorised workshop if he is of the opinion that the authorised workshop has not performed its work satisfactorily, and any authorisation to which the notice relates shall cease to have effect on the date specified in the notice.

Testing equipment

7. If so requested by the Registrar, an authorised workshop shall allow him to use such equipment for testing a speed warning device as may be specified by him.

Offences

8.—(1) Any person who —

(a)	adjusts or tampers with a speed warning device or any cable or wire connected with its operation in any manner that prevents the device from operating as specified in rule 4(3);
(b)	breaks any seal on a speed warning device, except as authorised by the Registrar; or
(c)	drives a vehicle installed with a speed warning device under these Rules when the device is faulty or when any of the seals on the device is broken, except where the vehicle is being driven for the sole purpose of having it sent to an authorised workshop for it to be checked, repaired or resealed,

shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $500.

(2) The owner of a vehicle installed with a speed warning device under these Rules shall ensure that —

(a)	the speed warning device or any cable or wire connected with its operation is not adjusted or tampered with in any manner that prevents the device from operating as specified in rule 4(3);
(b)	any seal on the speed warning device is not broken and, where such seal is broken, he shall as soon as is practicable send the vehicle to an authorised workshop for the device to be checked and re-sealed; and
(c)	at all times the speed warning device is accurate and in a proper working condition.

(3) Any person who contravenes or fails to comply with paragraph (2) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $500.
