(Composition of Offences)
(Amendment) Rules 2021

In exercise of the powers conferred by section 104(3) of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Rules:

Citation and commencement

1. These Rules are the Environmental Public Health (Composition of Offences) (Amendment) Rules 2021 and come into operation on 1 January 2022.

Amendment of rule 2

2. Rule 2 of the Environmental Public Health (Composition of Offences) Rules (R 1) is amended —

(a)

by deleting “, 64(1)” in paragraph (a)(i);

(b)

by deleting the words “, (3) or (4), 63, 64(2)” in paragraph (a)(ii) and substituting the words “or (3)”;

(c)

by inserting, immediately after “58(5),” in paragraph (a)(iii), “61A(5), 62A(5), 62B(3), 62C(6), 62D(5), 63(2), 64(6), 65(5), 66A(7), 66B(6), 66C(5),”;

(d)

by deleting paragraph (ba);

(e)

by deleting paragraph (ea) and substituting the following paragraph:

“(ea)

any offence under the Environmental Public Health (Registrable Aerosol‑generating Systems) Regulations 2021 (G.N. No. S 646/2021);”;

(f)

by deleting paragraph (g) and substituting the following paragraph:

“(g)	any offence under the Environmental Public Health (Licensable Aquatic Facilities) Regulations 2021 (G.N. No. S 644/2021);”; and

(g)

by deleting the full‑stop at the end of paragraph (i) and substituting a semi‑colon, and by inserting immediately thereafter the following paragraphs:

“(j)	any offence under the Environmental Public Health (Specified Premises) Regulations 2021 (G.N. No. S 533/2021);
(k)	any offence under the Environmental Public Health (Specified Construction Sites) Regulations 2021 (G.N. No. S 727/2021).”.
