Land Titles (Amendment No. 3) Rules 1998

In exercise of the powers conferred by section 170 of the Land Titles Act, the Minister for Law hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Land Titles (Amendment No. 3) Rules 1998 and shall come into operation on 1st April 1998.

Amendment of Schedule

2. The Schedule to the Land Titles Rules (R 1) is amended —

(a)

by deleting item 8 and substituting the following item:

“8.	Registration or notification of the following instruments:

(a)

transfer

(b)

mortgage

(c)	sub-mortgage

(d)

charge

(e)	postponement

(f)

lease

(g)	grant or release of an easement

(h)	restriction

(i)	statutory obligation or acquisition

(j)	declaration relating to manner or holding by co-tenants

(k)	transmission to personal representatives or Official Assignee upon the death or bankruptcy of a proprietor, or a person other than personal representatives

(l)	entitlement to an interest upon death of a joint tenant or a life tenant or upon defeasance of the interest of the proprietor

(m)	writ or summons

(n)	order of court

(o)	cancellation of registration of an instrument referred to in paragraph (m) or (n)

(b)

by deleting item 28 and substituting the following item:

“28.	Fees for each search in electronic form:

(a)	to view or per printout of the Caveat Index

(b)	printout of —

(i)	a folio of the land register

14.

(ii)	details of the estate and land in a folio of the land register

(iii)

details of the proprietor in a folio of land register

(iv)	other details of the property in a folio of the land register

(c)	printout giving details of a pending instrument

(d)	printout giving details of a registered instrument

(e)	printout giving details of a power of attorney

(f)	printout giving details of a strata titles plan

(g)	Lot Base System printout of —

(i)	the current information on a lot

(ii)	the derivation, sub-division, amalgamation and other particulars of a lot including indices to lands and caveats

(h)	printout giving the history of the instruments shown on and lodged against the certificate of title after it was computerised

(i)	certification of a printout for paragraphs (a) to (h) (excluding cost of printout)

2.00 per page or part thereof.”.
