Town Council of Pasir Ris (Penalties for Late Payment of Conservancy and Service Charges, Licence Fees and Other Charges) By-laws 2001
In exercise of the powers conferred by section 24(2)(c) of the Town Councils Act, the Town Council for the Town of Pasir Ris hereby makes the following By-laws:
Citation and commencement
1.  These By-laws may be cited as the Town Council of Pasir Ris (Penalties for Late Payment of Conservancy and Service Charges, Licence Fees and Other Charges) By-laws 2001 and shall be deemed to have come into operation on 1st January 2001.
Calculation of penalties for conservancy and service charges, licence fees and other charges in arrears
2.—(1)  Subject to paragraph (2), where any conservancy and service charge, licence fee or other charge payable in respect of any commercial, communal or residential property by any tenant, owner or licensee to the Town Council of Pasir Ris is in arrears, the tenant, owner or licensee, as the case may be, shall be liable to pay the Town Council in respect of the first month in which the conservancy and service charge, licence fee or other charge is due and unpaid, a penalty calculated at the rate of —
(a)1% of the amount unpaid per month in respect of a residential property; and
(b)5% of the amount unpaid per month in respect of a commercial or communal property.
(2)  The minimum penalty per month imposed on any outstanding conservancy and service charge, licence fee or other charge under paragraph (1) shall be —
(a)$1 for 1-room flats;
(b)$2 for 2-room flats;
(c)$3 for 3-room flats;
(d)$4 for 4-room flats;
(e)$5 for 5-room flats, executive apartments, maisonettes and multi-generation properties (Type A/B/C); and
(f)$30 for commercial or communal properties.
(3)  A penalty determined in accordance with paragraphs (1) and (2) shall be payable for every month in which any conservancy and service charge, licence fee or other charge is in arrears on the last day of that month and shall be accumulative until payment is made by the tenant, owner or licensee.
(4)  For the purpose of ascertaining the date on which any conservancy and service charge, licence fee or other charge is deemed fully paid, all moneys tendered by any tenant, owner or licensee towards payment of the conservancy and service charges, licence fees or other charges will first go towards satisfaction of the longest outstanding charge or fee, followed by the next in time and so forth in the order in which the charges or fees were first imposed.
(5)  In paragraph (1), “first month” means the first month following a period of at least one month where the conservancy and service charge, licence fee or other charge, as the case may be, is not in arrears.
Application of payment
3.  The Town Council may, in its discretion, apply any moneys paid by the tenant, owner or licensee under these By-laws —
(a)firstly towards the payment of the amount of any penalty payable under these By-laws; and
(b)thereafter apply any balance of such moneys towards payment of the amount of conservancy and service charge, licence fee or other charge or part thereof which remains in arrears.
Remission
4.  The Town Council may, in its discretion, remit wholly or in part any penalty payable under these By-laws.
Revocation
5.  The Town Council of Pasir Ris (Penalties for Late Payment of Conservancy and Service Charges) By-Laws (By 3) are revoked.
Transitional
6.  Where any penalty which has been imposed under the revoked Town Council of Pasir Ris (Penalties for Late Payment of Conservancy and Service Charges) By-laws remains unpaid on 1st January 2001, such penalty shall remain payable as if it had been imposed by the Town Council under these By-laws.
