(Public Cleansing) (Amendment)
Regulations 2023

In exercise of the powers conferred by section 111 of the Environmental Public Health Act 1987, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:

Citation and commencement

1. These Regulations are the Environmental Public Health (Public Cleansing) (Amendment) Regulations 2023 and come into operation on 1 April 2023.

Amendment of regulation 28

2. In the Environmental Public Health (Public Cleansing) Regulations (Rg 3), in regulation 28, after paragraph (2), insert —

“(3) The fees specified in the Second Schedule do not include any GST chargeable on the supply of the services of the collection, removal and disposal of refuse, and the person liable to pay the fee for the services supplied must, as part of the fee, pay an amount equivalent to the GST chargeable on the supply.

(4) In this regulation, “GST”, in relation to the supply of any services, means the goods and services tax chargeable under the Goods and Services Tax Act 1993, calculated at the rate prevailing at the time the tax is charged on the supply.”.

3. In the Environmental Public Health (Public Cleansing) Regulations, in the Second Schedule —
