Misuse of Drugs Act
(Amendment of First Schedule)
Order 2019

In exercise of the powers conferred by section 59 of the Misuse of Drugs Act, the Minister for Home Affairs makes the following Order:

Citation and commencement

1. This Order is the Misuse of Drugs Act (Amendment of First Schedule) Order 2019 and comes into operation on 25 March 2019.

Amendment of Part I of First Schedule

2. Paragraph 18 of Part I of the First Schedule to the Misuse of Drugs Act is amended —

(a)

by inserting, immediately after item (19ABA), the following item:

“(19ABB)

2-[1-(4-Fluorobutyl)-1H-indazole-3-carboxamido]-3,3-dimethylbutanoic acid and its hexanoic acid isomers and their respective fluoro positional isomers in the butyl group”;

(b)

by inserting, immediately after item (28G), the following item:

“(28GA)

Methyl 2-[1-(4-fluorobutyl)-1H-indazole-3-carboxamido]-3,3-dimethylbutanoate (also known as 4-Fluoro-MDMB-BINACA) and its hexanoate isomers and their respective fluoro positional isomers in the butyl group”; and

(c)

by inserting, immediately after item (29), the following item:

“(29AA)

Methyl 2-[1-(4-hydroxybutyl)-1H-indazole-3-carboxamido]-3,3-dimethylbutanoate and its hexanoate isomers and their respective hydroxy positional isomers in the butyl group”.
