(Registration of Professional Deputies)
(Amendment) Regulations 2023
In exercise of the powers conferred by section 46 of the Mental Capacity Act 2008, the Minister for Social and Family Development makes the following Regulations:
Citation and commencement
1.—(1)  These Regulations are the Mental Capacity (Registration of Professional Deputies) (Amendment) Regulations 2023 and, except for regulation 3, come into operation on 1 April 2023.
(2)  Regulation 3 is deemed to have come into operation on 31 December 2021.
Amendment of regulation 2
2.  In the Mental Capacity (Registration of Professional Deputies) Regulations 2018 (G.N. No. S 529/2018), in regulation 2, in the definition of “eligible professional”, in paragraph (c), replace “Singapore Accountancy Commission Act 2013” with “Accounting and Corporate Regulatory Authority Act 2004”.
Miscellaneous amendments
3.  In the Mental Capacity (Registration of Professional Deputies) Regulations 2018 —
(a)in regulation 2, in the definition of “eligible professional”, in paragraph (a), replace “(Cap. 161)” with “1966”;
(b)in regulation 2, in the definition of “eligible professional”, in paragraph (b), replace “(Cap. 2)” with “2004”;
(c)in regulation 2, in the definition of “eligible professional”, in paragraph (c), replace “(Cap. 294B)” with “2013”;
(d)in regulation 2, in the definition of “eligible professional”, in paragraph (d), replace “(Cap. 174)” with “1997”;
(e)in regulation 2, in the definition of “eligible professional”, in paragraph (e), replace “(Cap. 6B)” with “2011”;
(f)in regulation 2, in the definition of “eligible professional”, in paragraph (f), replace “(Cap. 209)” with “1999”;
(g)in regulation 2, in the definition of “specified offence”, replace paragraphs (b) and (c) with —
(b)any offence specified in Chapter 8, 14 or 16 of the Penal Code 1871;
(c)any offence specified in Part 3 of the Miscellaneous Offences (Public Order and Nuisance) Act 1906, or in the Public Order Act 2009.”; and
(h)in regulation 5, in paragraph (a), replace “(Cap. 336)” with “2005”.
