Land Surveyors Act

Land Surveyors (Code of Professional Conduct and Ethics) (Amendment) Rules 2007
In exercise of the powers conferred by section 38(1) of the Land Surveyors Act, the Land Surveyors Board, with the approval of the Minister for Law, hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Land Surveyors (Code of Professional Conduct and Ethics) (Amendment) Rules 2007 and shall come into operation on 2nd May 2007.
Amendment of rule 2
2.  Rule 2 (2) of the Land Surveyors (Code of Professional Conduct and Ethics) Rules (R 5) is amended by deleting the words “and partnership” and substituting the words “, partnership and limited liability partnership”.
Amendment of Schedule
3.  The Schedule to the Land Surveyors (Code of Professional Conduct and Ethics) Rules is amended —
(a)by inserting, immediately after the words “licensed partnership” in the definition of “practising registered surveyor” in paragraph 1, the words “or limited liability partnership”;
(b)by inserting, immediately after the words “his firm” in paragraph 3(4), the words “, limited liability partnership”;
(c)by deleting the words “or partnership,” in paragraph 3(4) and substituting the words “, partnership or limited liability partnership”;
(d)by deleting the words “or partnership” wherever they appear in the following paragraphs and substituting in each case the words “, partnership or limited liability partnership”:
Paragraphs 4(2)(a) and (b), 10, 12 (4), 16, 17 (1), (2), (3)(d), (4), (6), (7), (8), (9) and (10), 18 (2) and (3), 19 (1) and (2), 20 (1) and (2), 21 (1) and (2), 22 (1) and (2), 23 and 24;
(e) by deleting sub-paragraphs (a) and (b) of paragraph 6(2) and substituting the following sub-paragraphs:
(a)who is a partner of a firm or a limited liability partnership, a director of a corporation or an employee of a firm, a limited liability partnership or a corporation shall not act as a surveyor in respect of a contract to which such firm, limited liability partnership or corporation is a party;
(b)shall not act as a surveyor in respect of any project in which he, or a firm or a limited liability partnership of which he is a partner, or a corporation of which he is a director, is acting as a housing developer or estate agent; or”;
(f) by deleting the words “or other surveying firm or office in which he has financial interest” in paragraph 12(4); and
(g)by inserting, immediately after the words “licensed corporation” in paragraph 18(1), the words “, partnership or limited liability partnership”.
