Legal Profession Act

Legal Profession (Qualified Persons) (Amendment) Rules 2008
In exercise of the powers conferred by section 2(2) and (3) of the Legal Profession Act, the Minister for Law, after consultation with the Board of Legal Education, hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Legal Profession (Qualified Persons) (Amendment) Rules 2008 and shall come into operation on 1st April 2008.
Amendment of heading to Part II
2.  Part II of the Legal Profession (Qualified Persons) Rules (R 15) (referred to in these Rules as the principal Rules) is amended by deleting the words “NATIONAL UNIVERSITY OF SINGAPORE” in the Part heading and substituting the words “INSTITUTIONS OF HIGHER LEARNING IN SINGAPORE”.
Deletion and substitution of rule 5 and new rule 5A
3.  Rule 5 of the principal Rules is deleted and the following rules substituted therefor:
Persons admitted as candidates for degree of Bachelor of Laws by National University of Singapore on or after 1st May 1993
5.  Any person admitted as a candidate for the degree of Bachelor of Laws by the National University of Singapore on or after 1st May 1993 shall be a qualified person if —
(a)he has passed the final examination for that degree; and
(b)he has attained at least lower second class honours in relation to that degree.
Persons admitted as candidates for degree of Bachelor of Laws by Singapore Management University
5A.  Any person admitted as a candidate for the degree of Bachelor of Laws by the Singapore Management University shall be a qualified person if —
(a)he has passed the final examination for that degree; and
(b)he has attained a grade point average of at least 3.00 in the course of study leading to that degree.”.
Amendment of heading to Part III
4.  Part III of the principal Rules is amended by deleting the words “IN UNITED KINGDOM OR ELSEWHERE” in the Part heading and substituting the words “OUTSIDE SINGAPORE”.
Amendment of rule 15A
5.  Rule 15A of the principal Rules is amended —
(a)by deleting sub-paragraph (ii) of paragraph (2)(c) and substituting the following sub-paragraph:
(ii)after obtaining the degree referred to in rule 8(2)(ii), 9(1), (2) or (2A) or 9A(1), has been engaged in work of a legal nature for at least 2 years and has obtained relevant legal experience.”;
(b)by deleting sub-paragraph (c) of paragraph (3) and substituting the following sub-paragraphs:
(c)as a legal executive (by whatever name called) in —
(i)any statutory body or law office in the public service;
(ii)the Academy; or
(iii)the Society;
(ca)as a legal editor in the Academy; or”;
(c)by deleting the words “3 years” wherever they appear in paragraph (4) and substituting in each case the words “2 years”; and
(d)by deleting the words “5 years” in paragraph (4) and substituting the words “4 years”.
