Road Traffic Act

Road Traffic (Motor Vehicles, Registration and Licensing) (Amendment No. 2) Rules 2009
In exercise of the powers conferred by sections 34 and 140 of the Road Traffic Act, the Minister for Transport hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Motor Vehicles, Registration and Licensing) (Amendment No. 2) Rules 2009 and shall come into operation on 9th May 2009.
Amendment of rule 36
2.  Rule 36 of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5) (referred to in these Rules as the principal Rules) is amended —
(a)by deleting the word “and” at the end of paragraph (4)(a); and
(b)by inserting, immediately after paragraph (4), the following paragraph:
(4A)  Notwithstanding paragraph (4), the fee payable for a licence under this rule —
(a)for a taxi, or a bus, goods vehicle or goods-cum-passengers vehicle using diesel or petroleum as fuel; and
(b)that commences on any date between 1st July 2009 and 30th June 2010 (both dates inclusive),
shall be the appropriate fee specified in the Fourteenth Schedule.”.
Deletion and substitution of rule 36C
3.  Rule 36C of the principal Rules is deleted and the following rule substituted therefor:
Licence fee for buses, goods vehicles and goods-cum-passengers vehicles which are CNG vehicles, electric vehicles or hybrid vehicles
36C.—(1)  The fee payable for a licence that commences on or after 1st January 2006 for a bus, goods vehicle or goods-cum-passengers vehicle which is a CNG vehicle, an electric vehicle or a hybrid vehicle shall be the appropriate fee specified in —
(a)the Tenth Schedule, if the licence commences on any date between 1st January 2006 and 30th June 2008 (both dates inclusive); and
(b)the Twelfth Schedule, if the licence commences on or after 1st July 2008.
(2)  Notwithstanding paragraph (1), the fee payable for a licence referred to in that paragraph that commences on any date between 1st July 2009 and 30th June 2010 (both dates inclusive) shall be the appropriate fee specified in the Fourteenth Schedule.”.
Amendment of Tenth Schedule
4.  The Tenth Schedule to the principal Rules is amended by deleting the words “LIGHT GOODS VEHICLES AND HEAVY GOODS VEHICLES (EXCLUDING PRIME MOVERS)” in the Schedule heading and substituting the words “GOODS VEHICLES AND GOODS-CUM-PASSENGERS VEHICLES”.
Amendment of Twelfth Schedule
5.  The Twelfth Schedule to the principal Rules is amended —
(a)by inserting, immediately after paragraph (d) of item 6, the following paragraphs:

Notes:
1  For the purposes of computing fees payable under this Schedule, any fraction of a dollar shall be reckoned as one dollar.
2.  Monthly licence fee payable shall be computed on a pro-rata basis.
3.  Annual licence fee payable shall be double the half-yearly licence fee and shall be computed on a pro-rata basis.
4.  Taxis equipped with engines using heavy oil, diesel oil, liquefied petroleum gas, natural gas or any other gas as fuel or fitted with producer gas or other gas attachments are chargeable with additional special tax under the Customs Act (Cap. 70).”.
Transitional provisions
7.—(1)  Where a licence —
(a)for a taxi, or a bus, goods vehicle or goods-cum-passengers vehicle using diesel or petroleum as fuel, under rule 36 of the principal Rules; or
(b)for a bus, goods vehicle or goods-cum-passengers vehicle which is a CNG vehicle, an electric vehicle or a hybrid vehicle under rule 36C of the principal Rules,
commences before 1st July 2009 and expires on or after that date, the fee payable for the licence under that rule shall be the sum of —
(i)such portion of the appropriate fee specified in the Tenth, Eleventh or Twelfth Schedule (as the case may be) to the principal Rules, and any additional licence fee payable under rule 37 thereof, computed on a pro-rata basis for the period of the licence up to and including 30th June 2009; and
(ii)such portion of the appropriate fee specified in the Fourteenth Schedule to the principal Rules, and any additional licence fee payable under rule 37 thereof, computed on a pro-rata basis for the remaining period of the licence from and including 1st July 2009.
(2)  If the licence referred to in paragraph (1) is issued before 9th May 2009, the holder of the licence shall be granted a rebate by the Registrar of an amount equivalent to the amount by which the licence fee paid by the holder exceeds the licence fee which is payable by virtue of the pro-rata computation under that paragraph.
