Education Endowment and Savings Schemes
(Post-Secondary Education Scheme)
(Amendment) Regulations 2011

In exercise of the powers conferred by section 24 of the Education Endowment and Savings Schemes Act, the Minister for Education hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Education Endowment and Savings Schemes (Post-Secondary Education Scheme) (Amendment) Regulations 2011 and shall come into operation on 1st May 2011.

Amendment of regulation 2

2. Regulation 2 of the Education Endowment and Savings Schemes (Post-Secondary Education Scheme) Regulations (Rg 3) (referred to in these Regulations as the principal Regulations) is amended —

(a)

by deleting the definitions of “Children Development Account” and “Children Development Co-Savings Scheme” in paragraph (1) and substituting the following definitions:

“ “Child Development Account” means a bank account opened and maintained for a member of the Child Development Co-Savings Scheme under regulation 4(3) of the Child Development Co-Savings Regulations (Cap. 38A, Rg 2), and includes any Children Development Account opened for a member of that Scheme before 1st May 2011;

“Child Development Co-Savings Scheme” means the Child Development Co-Savings Scheme established by regulation 3 of the Child Development Co-Savings Regulations;

“co-savings arrangement” means the co-savings arrangement referred to in section 3(1)(a) of the Child Development Co-Savings Act (Cap. 38A);”; and

(b)

by deleting the word “Children” in paragraph (2) and substituting the word “Child”.

Amendment of regulation 4

3. Regulation 4 of the principal Regulations is amended —

(a)

by deleting paragraph (a) and substituting the following paragraphs:

“(a)

he is eligible for the co-savings arrangement and, as at 31st December in the year in which the sixth anniversary of his date of birth falls —

(i)	no Child Development Account has been opened for him; or
(ii)	the aggregate amount of all co-payment contributions by the Government to his Child Development Account under regulation 6(2) of the Child Development Co-Savings Regulations (Cap. 38A, Rg 2) has not reached the maximum payable under regulation 6(3) of those Regulations;

(aa)

immediately before 1st January in the year in which the seventh anniversary of his date of birth falls, there are moneys standing to his credit in his Child Development Account which are liable to be transferred under regulation 10(2)(a) of the Child Development Co-Savings Regulations;”; and

(b)

by deleting the words “immediately before that sum” in paragraph (b) and substituting the word “which”.

Amendment of regulation 5

4. Regulation 5 of the principal Regulations is amended —

(a)

by deleting the words “has no Children Development Account opened for him” in paragraph (1)(a) and substituting the words “satisfies the requirements under regulation 4(a)(i)”;

(b)

by deleting the words “has a Children Development Account opened for him, but the aggregate amount of all co-payment contributions by the Government to that Account under regulation 6(2) of the Children Development Co-Savings Regulations (Cap. 38A, Rg 2) has not reached the maximum payable under regulation 6(3) of those Regulations” in paragraph (1)(b) and substituting the words “satisfies the requirements under regulation 4(a)(ii)”;

(c)

by deleting sub-paragraph (b) of paragraph (2) and substituting the following sub-paragraph:

“(b)	all contributions, if any, made by the Government under the co-savings arrangement to the member’s Child Development Account, if any,”;

(d)

by deleting “4(a)(ii)(B)” in paragraph (4)(b)(i) and substituting “4(a)(ii)”; and

(e)

by deleting the word “Children” wherever it appears in paragraph (4)(b)(ii) and substituting in each case the word “Child”.

Amendment of First Schedule

5. The First Schedule to the principal Regulations is amended by deleting the word “Children” wherever it appears in Part II of that Schedule and substituting in each case the word “Child”.

Amendment of Second Schedule

6. The Second Schedule to the principal Regulations is amended by deleting the word “CHILDREN” in the Schedule heading and substituting the word “CHILD”.
