Town Council of Tanjong Pagar (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges, Licence Fees and Other Charges) By-laws 2002
In exercise of the powers conferred by section 24 (2)(a) and (c) of the Town Councils Act, the Town Council for the Town of Tanjong Pagar hereby makes the following By-laws:
Citation and commencement
1.  These By-laws may be cited as the Town Council of Tanjong Pagar (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges, Licence Fees and Other Charges) By-laws 2002 and shall come into operation on 1st June 2002.
Calculation of penalties for conservancy and service charges and licence fees in arrears
2.—(1)  Where any conservancy and service charge or licence fee payable in respect of any residential, commercial or communal property by any tenant, owner or licensee to the Town Council is in arrears, the tenant, owner or licensee, as the case may be, shall be liable to pay to the Town Council in respect of the first month, and for every month thereafter, in which such charge or licence fee or any part thereof is due and unpaid, a penalty calculated at the rate of —
(a)in the case of any residential property — 2% on the amount due and unpaid each such month subject to a minimum amount of $1; or
(b)in the case of any commercial or communal property — 5% on the amount due and unpaid each such month subject to a minimum amount of $5.
(2)  A penalty determined in accordance with paragraph (1) for any month in which any conservancy and service charge or licence fee or any part thereof is in arrears shall be due and payable on the last day of the month and shall be accumulative until payment of such charge or licence fee or part thereof in arrears is made by the tenant, owner or licensee, as the case may be.
(3)  In paragraph (1), “first month” means the first month following a period of at least one month where the conservancy and service charge or licence fee, as the case may be, is not in arrears.
Administrative fee
3.—(1)  Where any conservancy and service charge, licence fee or other charge or any part thereof remains unpaid for a period of 5 months or more from the date on which it was due, the tenant, owner or licensee liable for such charge or licence fee shall, in addition to any penalty which may be imposed under by-law 2, be liable to pay to the Town Council an administrative fee of $60.
(2)  The administrative fee referred to in paragraph (1) shall be payable only once so long as the conservancy and service charge, licence fee or other charge or any part thereof remains unpaid.
Recovery of licence fee
4.  Nothing in these By-laws shall prejudice any right of action or other remedy of the Town Council for the recovery of any moneys due to the Town Council in respect of any breach by the licensee under any licence agreement between the Town Council and the licensee.
Application of payment
5.  The Town Council may, in its discretion, apply any moneys paid by the tenant, owner or licensee under these By-laws —
(a)firstly towards the payment of the amount of any penalty or administrative fee payable under these By-laws; and
(b)thereafter apply any balance of such moneys towards payment of the amount of conservancy and service charge, licence fee or other charge or part thereof, which remains in arrears.
Remission
6.  The Town Council may, in its discretion, remit wholly or in part any penalty or administrative fee payable under these By-laws.
Cessation of By-laws
7.  The Town Council of Tanjong Pagar-West Coast (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges, Licence Fees and Other Charges) By-laws 2000 (G. N. No. S 463/2000) shall cease to apply to any area within the Town of Tanjong Pagar.
Transitional
8.  Where any penalty or administrative fee which has been imposed under the Town Council of Tanjong Pagar-West Coast (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges, Licence Fees and Other Charges) By-laws 2000 remains unpaid on 1st June 2002, such penalty or administrative fee shall remain payable as if it had been imposed by the Town Council under these By-laws.
