Exhibition and Conference 2023) Regulations 2023

In exercise of the powers conferred by section 11(1) of the Smoking (Prohibition in Certain Places) Act 1992, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:

Citation and period in force

1.—(1) These Regulations are the Smoking (Prohibition in Certain Places) (Temporary Smoking Facilities for Tax Free World Association Asia Pacific Exhibition and Conference 2023) Regulations 2023.

(2) These Regulations are in force for the period between 9 May 2023 and 11 May 2023 (both dates inclusive).

Definitions

2. In these Regulations —

“2023 exhibition” means the Tax Free World Association Asia Pacific Exhibition and Conference 2023 held in Singapore during the exhibition period;

“exhibition period” means the period between 9 May 2023 and 11 May 2023 (both dates inclusive);

“organiser” means the international association known as the Tax Free World Association;

“registered trade visitor” means a person who is registered to participate in or visit the 2023 exhibition;

“representative”, in relation to a tobacco exhibitor, means an employee, officer or agent of the tobacco exhibitor who participates in the 2023 exhibition on behalf of the tobacco exhibitor;

“tobacco exhibitor” means a participant in the 2023 exhibition specified in the Schedule.

Specified place

3. For the purposes of section 3A(1) of the Act, the place known as the Sands Expo and Convention Centre, Marina Bay Sands, at which the 2023 exhibition is held, is a specified place during the exhibition period.

Temporary smoking facilities in specified place

4. One or more smoking facilities may be located in the specified place under regulation 3 during the exhibition period if each smoking facility complies with the requirements mentioned in regulation 5.

Requirements for temporary smoking facilities

5.—(1) For the purposes of section 3C(1) of the Act, the prescribed requirements for a smoking facility mentioned in regulation 4 are all of the following:

(a)

the smoking facility may only be used for smoking for the purpose of the 2023 exhibition;

(b)

the smoking facility must be an enclosed room —

(i)	that is independently ventilated;
(ii)	that is visible and accessible only to registered trade visitors and representatives of tobacco exhibitors;
(iii)	that contains one or more receptacles suitable for the disposal of cigarette butts or any waste from smoking;
(iv)	for which a conspicuous sign must be displayed outside the enclosed room stating that the enclosed room is designated for smoking; and
(v)	for which air quality control measures are implemented for the purpose of preventing the exfiltration of tobacco smoke, and the effectiveness of those measures is monitored and assessed in accordance with paragraph (2);

(c)

entry to the smoking facility for the purpose of smoking is restricted to the following classes of individuals:

(i)	an individual whose registration as a registered trade visitor is verified by a representative of a tobacco exhibitor before the individual enters the smoking facility, and who is accompanied by a representative of a tobacco exhibitor when the individual smokes in the smoking facility;
(ii)	a representative of a tobacco exhibitor who accompanies a registered trade visitor to smoke in the smoking facility.

(2) For the purposes of paragraph (1)(b)(v), the effectiveness of the air quality control measures must be monitored and assessed on a real‑time basis by an independent consultant engaged by the organiser of the 2023 exhibition (whether directly or by another person on its behalf), including by monitoring —

(a)	the differential pressure between the smoking facility and the area immediately outside the smoking facility; and
(b)	the levels of airborne particulates (by what are commonly known as PM_2.5, PM₄ and PM₁₀) in the area immediately outside the smoking facility compared with the respective baseline levels established before the smoking facility is used for smoking.

(3) In this regulation, “smoking” means smoking a tobacco product, or a sample of a tobacco product, provided within the specified place by a tobacco exhibitor during the exhibition period.
