Environmental Pollution Control Act
(Chapter 94A)
Environmental Pollution Control (Control of Noise At Construction Sites) (Amendment) Regulations 2001
In exercise of the powers conferred by section 77(1) of the Environmental Pollution Control Act, the Minister for State, Ministry of the Environment, charged with the responsibility of the Minister for the Environment hereby, makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Environmental Pollution Control (Control of Noise at Construction Sites) (Amendment) Regulations 2001 and shall come into operation on 1st October 2001.
Amendment of regulation 3
2.  Regulation 3 of the Environmental Pollution Control (Control of Noise at Construction Sites) Regulations (Rg 2, 2001 Ed.) (referred to in these Regulations as the principal Regulations) is amended —
(a)by deleting paragraph (1) and substituting the following paragraph:
(1)  The owner or occupier of any construction site shall ensure that the level of noise emitted from his construction site shall not exceed the maximum permissible noise levels —
(a)in the case of any construction work which has commenced before 1st October 2001, set out in the First Schedule; and
(b)in the case of any construction work commencing on or after 1st October 2001, set out in the Second Schedule.”.
(b)by deleting the words “First Schedule shall be adjusted in accordance with the Second Schedule” in paragraph (3), and substituting the words “First and Second Schedules shall be adjusted in accordance with the Third Schedule”; and
(c)by inserting, immediately after paragraph (3), the following paragraphs:
(4)  Paragraph (b) of Parts I and II of the Second Schedule shall not apply to any construction site in which the following works are carried out:
(a)repair and maintenance work to public roads; and
(b)repair work to any sewer, drain, water, gas or electricity line.
(5)  For the purposes of these Regulations, construction work shall be deemed to have commenced on the date specified in a permit to carry out building works in that construction site granted by the Commissioner of Building Control under section 7 of the Building Control Act (Cap. 29).”.
Amendment of First Schedule
3.  The First Schedule to the principal Regulations is amended by inserting, immediately after the words “MAXIMUM PERMISSIBLE NOISE LEVELS” in the 3rd line, the words “FOR CONSTRUCTION WORK COMMENCED BEFORE 1ST OCTOBER 2001”.
New Second Schedule
4.  The principal Regulations are amended by inserting, immediately after the First Schedule, the following Schedule:

Amendment of existing Second Schedule
5.  The existing Second Schedule to the principal Regulations is amended —
(a)by deleting the words “First Schedule” in the 6th line and substituting the words “First and Second Schedules”; and
(b)by renaming the Schedule as the Third Schedule.
