Parking Places (Surcharge) (Closure of
Parking Lots Scheme) Rules 1998
In exercise of the powers conferred by sections 7 and 9 of the Parking Places (Surcharge) Act, the Minister for Communications hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Parking Places (Surcharge) (Closure of Parking Lots Scheme) Rules 1998 and shall come into operation on 8th May 1998.
Definitions
2.  In these Rules —
“heavy vehicle” has the same meaning as in the Parking Places Act (Cap.214);
“parking lot” means the space m.arked out in a parking place for the parking of one motor vehicle not being a heavy vehicle, a motor cycle or a scooter.
Closure of parking lots
3.—(1)  The owner of any parking place may, with the approval of the Superintendent, close any parking lot within that parking place.
(2)  An application for the approval of the Superintendent under paragraph (1) shall be made in such form and shall be accompanied by such information or document as the Superintendent may require.
(3)  Upon receiving an application for the closure of any parking lot under paragraph (2), the Superintendent may grant his approval for the parking lot to be closed for such period as he may specify.
Effect of closure of parking lots
4.  Where the Superintendent has granted his approval for the closure of any parking lot in any parking place under rule 3, the owner of the parking place —
(a)shall not, without the prior approval of the Superintendent, allow any motor vehicle to be parked in the parking lot except during the following hours:
(i)from 7.00 p.m. on Friday to 7.00 a.m. on the following Monday; and
(ii)from 7.00 p.m. on the eve of a public holiday to 7.00 a.m. on the day following the public holiday; and
(b)shall cause a temporary barrier to be erected at the parking lot to prevent any motor vehicle from being parked in that parking lot at all times other than the hours referred to in paragraph (a)(i) and (ii).
Exemption of closed parking lots from surcharge
5.  Section 3 of the Act shall not apply in respect of any parking lot which has been closed under rule 3.
Re-opening of parking lots
6.—(1)  The owner of any parking place may, with the approval of the Superintendent, re-open any parking lot which has been closed under rule 3 for use for the parking of cars.
(2)  An application for the approval of the Superintendent under paragraph (1) shall be made in such form as the Superintendent may require.
(3)  Upon receiving an application for the re-opening of any parking lot under paragraph (2), the Superintendent may grant his approval for any parking lot which has been closed under rule 3 to be re-opened for use for the parking of cars.
Surcharge for parking lots re-opened under rule 6
7.  Where the Superintendent has approved the re-opening of any parking lot in a parking place under rule 6, there shall be payable in respect of that parking lot for every month from the time which the parking lot is re-opened a surcharge which shall be calculated in accordance with the following formula:

A is the number of days (excluding Saturdays, Sundays and public holidays) on which the parking lot is re-opened under rule 6 during the month in respect of which the surcharge is levied;
B is the number of days in the month in respect of which the surcharge is levied; and
C is the rate of surcharge specified in the Parking Places (Surcharge) Order (O 1) as is applicable in respect of that parking lot.
Revocation of approval for closure of parking lots
8.—(1)  The Superintendent may revoke his approval for the closure of any parking lot under rule 3 if the owner of the parking place has permitted any motor vehicle to be parked in the parking lot or any part thereof in contravention of rule 4.
(2)  Where the Superintendent has revoked his approval for the closure of any parking lot in any parking place, the owner of the parking place shall be liable to pay to the Superintendent on demand the amount of the surcharge which would have been levied under the Parking Places (Surcharge) Order in respect of that parking lot had the Superintendent not approved its closure.
(3)  The surcharge referred to in paragraph (2) shall be calculated from the date on which the Superintendent granted his approval for the closure of the parking lot under rule 3.
