Town Council of City Centre (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges, Licence Fees and Other Charges) By-laws 1997
In exercise of the powers conferred by section 24(2)(a) and (c) of the Town Councils Act, the Town Council for the Town of City Centre hereby makes the following By-laws:
Citation and commencement
1.  These By-laws may be cited as the Town Council of City Centre (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges, Licence Fees and Other Charges) By-laws 1997 and shall come into operation on 13th June 1997.
Calculation of penalties and administrative fee for conservancy and service charges in arrears
2.—(1)  The tenant or owner shall be liable to pay the Town Council of City Centre a penalty at the appropriate rate set out in the Schedule for every month in which any conservancy and service charges payable by him to the Town Council is in arrears and the penalty shall become due and payable on the day following the expiry of that month.
(2)  An owner, tenant or licensee shall be liable to pay the Town Council —
(a)an administrative fee of $2 —
(i)if any conservancy and service charges are not paid before the last working day of the month from the expiry of one month after the date the charges become due and payable; or
(ii)if any penalty imposed under paragraph (1) is not paid before the last working day of the month after the penalty becomes due and payable; and
(b)in addition to any penalty or administrative fee that may be imposed under paragraph (1) or sub-paragraph (a), respectively, an administrative fee of $50 where any conservancy and service charges, licence fee or other charge payable by any tenant, owner or licensee to the Town Council remains unpaid for a period exceeding 6 months from the date on which it was due to be paid.
(3)  The administrative fee of $50 referred in paragraph (2)(b) shall be payable once so long as the conservancy and service charges or part thereof remain unpaid.
Application of payment
3.  The Town Council may, in its discretion, apply any moneys paid by the owner, tenant or licensee firstly towards the payment of the amount of any penalty or administrative fee payable under these By-laws and thereafter apply any balance of such moneys towards the amount of conservancy and service charges, licence fees or other charges or any part thereof which remains in arrears.
Remission
4.  The Town Council may, in its discretion, remit wholly or in part any penalty and administrative fee payable under these By-laws.
Revocation
5.—(1)  The Town Council of City Centre (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges) By-laws (By 12) are revoked.
(2)  Where any penalty or administrative fee which has been imposed under the revoked Town Council of City Centre (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges) By-laws (By 12) remains unpaid on 13th June 1997, such penalty or administrative fee shall remain payable as if it had been imposed by the Town Council under these By-laws.
