Road Traffic (Taxi Vocational Licence Demerit Points System) Rules 2003
In exercise of the powers conferred by section 111 of the Road Traffic Act, the Land Transport Authority of Singapore hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Road Traffic (Taxi Vocational Licence Demerit Points System) Rules 2003 and shall come into operation on 28th June 2003.
Definitions
2.  In these Rules, unless the context otherwise requires —
“scheduled offence” means an offence specified in the first column of the First Schedule;
“taxi vocational licence” means a licence to act as a driver of a taxi granted under rule 6(1)(d) of the Road Traffic (Public Service Vehicles) (Vocational Licences and Conduct of Drivers, Conductors and Passengers) Rules (R 8).
Award of demerit points
3.—(1)  Where the holder of a taxi vocational licence —
(a) is convicted of a scheduled offence committed on or after 28th June 2003; or
(b)pays a sum of money to compound a scheduled offence he is reasonably suspected to have committed on or after 28th June 2003,
the Registrar shall award against that holder the demerit points specified in the third column of the First Schedule for the scheduled offence.
(2)  The Registrar shall keep a register setting out the names of all holders of taxi vocational licences who have been awarded demerit points, and such other particulars as the Registrar thinks fit.
Suspension and revocation of taxi vocational licence
4.—(1)  Where the holder of a taxi vocational licence —
(a) is convicted of a scheduled offence committed on or after 28th June 2003; or
(b)pays a sum of money to compound a scheduled offence he is reasonably suspected to have committed on or after 28th June 2003,
the Registrar, in his discretion and in addition to the award of demerit points against such holder under rule 3, may suspend the taxi vocational licence of that holder under section 110(4) of the Act for the period specified in the Second Schedule for the applicable total number of demerit points awarded against the holder.
(2)  For the purpose of paragraph (1), the total number of demerit points shall consist of the following:
(a)the demerit points awarded under these Rules against the holder of the taxi vocational licence for the scheduled offence referred to in paragraph (1); and
(b)all other demerit points awarded under these Rules against the holder of the taxi vocational licence in respect of any scheduled offence that he has committed or is reasonably suspected to have committed within a period of 24 months ending on the date of commission of the scheduled offence referred to in paragraph (1).
(3)  Where the total number of demerit points referred to in paragraph (2) exceeds 20, the Registrar may, in his discretion, instead of suspending the taxi vocational licence, revoke the taxi vocational licence under section 110(4) of the Act.
Registrar to send notice
5.—(1)  Where the Registrar intends to suspend or revoke a taxi vocational licence under rule 4, the Registrar shall notify the holder of the taxi vocational licence by notice in writing of the date on which the suspension or revocation of his taxi vocational licence is to take effect.
(2)  The Registrar shall, in the notice referred to in paragraph (1), require the holder of the taxi vocational licence to show cause within 14 days from the date of the notice as to why his licence should not be suspended or revoked.
(3)  On the date specified in the notice, the Registrar shall, after taking into consideration the facts in mitigation (if any) submitted by the holder of the taxi vocational licence, suspend or revoke the taxi vocational licence (as the case may be) or make such other order as he thinks fit.
