(Chauffeured Private Hire Cars — Exemption)
Order 2017
In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Transport makes the following Order:
Citation and commencement
1.  This Order is the Road Traffic (Chauffeured Private Hire Cars — Exemption) Order 2017 and comes into operation on 20 June 2017.
Definitions
2.  In this Order, unless the context otherwise requires —
“chauffeured private hire car” means a motor car that —
(a)does not ply for hire on any road; and
(b)is hired, or made available for hire, under a contract (express or implied) for use as a whole with a driver for the purpose of conveying the hirer, and one or more passengers (if any), in that car;
“chauffeured private hire car driver” means an individual who drives, for reward, a licensed chauffeured private hire car hired with the individual;
“exempt chauffeured private hire car driver” means an individual who is exempt under paragraph 3;
“licence”, in relation to a motor car, means a public service vehicle licence issued under section 102 of the Act authorising the use of that motor car as a private hire car;
“vocational licence” means a vocational licence granted under section 110 of the Act authorising the holder of the vocational licence to be a chauffeured private hire car driver.
Exempt chauffeured private hire car drivers
3.—(1)  Section 110(1)(a) of the Act does not apply to, or in relation to, an individual who, on or after 1 July 2017, is a chauffeured private hire car driver if the individual applies, before that date, to the Authority for a vocational licence under the Road Traffic (Public Service Vehicles) (Vocational Licences and Conduct of Drivers, Conductors, Trishaw Riders and Passengers) Rules (R 8).
(2)  The exemption in sub-paragraph (1) ceases on the earlier of the following dates:
(a)the date the Registrar issues to the individual the vocational licence applied for;
(b)the date the individual’s application for the vocational licence is refused or is withdrawn.
Exemption for employer of exempt chauffeured private hire car driver
4.—(1)  Section 110(1)(b) of the Act does not apply to the employer of an exempt chauffeured private hire car driver.
(2)  Rule 6 of the Road Traffic (Public Service Vehicles) Rules (R 14) does not apply to the holder of a licence for a private hire car when the car is driven by an exempt chauffeured private hire car driver.
