Control of Plants (Phytosanitary Certification) (Amendment) Rules 2005

In exercise of the powers conferred by section 49 of the Control of Plants Act, the Minister for National Development hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Control of Plants (Phytosanitary Certification) (Amendment) Rules 2005 and shall come into operation on 1st June 2005.

Deletion and substitution of rule 2

2. Rule 2 of the Control of Plants (Phytosanitary Certification) Rules (R 6) (referred to in these Rules as the principal Rules) is deleted and the following rule substituted therefor:

“Definitions

2. In these Rules —

“accredited pest control agency” means a person registered by the Director-General under section 27 of the Act;

“consignment” means a consignment of plants, plant products or other regulated articles to be loaded onto a vessel at any one time on behalf of one exporter;

“regulated article” means any plant, plant product, storage place, packaging, conveyance, container, soil or any other organism, object or material capable of harbouring or spreading pests and deemed to require phytosanitary measures where international transportation is involved;

“treatment certificate” means any certificate issued by an accredited pest control agency for a treatment applied to regulated articles and completed in accordance with the requirements of the Director-General or the importing country.”.

Amendment of rule 4

3. Rule 4 of the principal Rules is amended —

(a)	by inserting, immediately after the words “authorised officer” in the 3rd line of paragraph (1), the words “or an accredited pest control agency”; and
(b)	by inserting, immediately after the words “authorised officer” in paragraph (2), the words “or accredited pest control agency”.

Amendment of rule 5

4. Rule 5 of the principal Rules is amended —

(a)

by deleting the words “and is practically free from other injurious pests” in paragraph (1)(a)(ii) and substituting the words “as specified by the importing country”;

(b)

by inserting, immediately after the words “importing country” in paragraph (1)(a)(iii), the words “, including those for regulated non-quarantine pests”; and

(c)

by deleting paragraph (2) and substituting the following paragraphs:

“(2) A phytosanitary certificate issued in respect of regulated articles that originate from Singapore shall be in Form 1 in the First Schedule.

(3) A phytosanitary certificate for re-export issued in respect of regulated articles that do not originate from Singapore shall be in Form 2 in the First Schedule.”.

Amendment of rule 6

5. Rule 6 of the principal Rules is amended by deleting the words “any fumigation certificate issued by a local licensed fumigator” and substituting the words “any treatment certificate”.

Deletion and substitution of First Schedule

6. The First Schedule to the principal Rules is deleted and the following Schedule substituted therefor:

“FIRST SCHEDULE

Rule 5(2) and (3)

”.

Amendment of Second Schedule

7. The Second Schedule to the principal Rules is amended —

(a)

by deleting the words “or fresh cut flowers” in items (1) and (2) under the heading “Service rendered” and substituting in each case the words “, fresh cut flowers or other regulated articles”;

(b)

by deleting the full-stop at the end of sub-paragraph (iii) of item (1)(a) under the heading “ Fee payable” and substituting a semi-colon, and by inserting immediately thereafter the following sub-paragraph:

“(iv)

Other regulated articles not exceeding 5 kg.”.

(c)

by deleting the full-stop at the end of sub-paragraph (iii) of item (1)(b) under the heading “ Fee payable” and substituting a semi-colon, and by inserting immediately thereafter the following sub-paragraph:

“(iv)

Other regulated articles exceeding 5 kg.”;

(d)

by deleting the words “or plant products” in item (3) under the heading “Service rendered” and substituting the words “, plant products or other regulated articles”; and

(e)

by deleting the words “fumigation certificate” in item (5) under the heading “Service rendered” and substituting the words “treatment certificate”.

Miscellaneous amendments

8. The principal Rules are amended —

(a)

by deleting the word “Director” in the following provisions and substituting in each case the word “Director-General”:

Rules 3(1), 9(1) to (4) and 10(a); and

(b)

by deleting the words “plants or plant products” wherever they appear in the following provisions and substituting in each case the words “plants, plant products or other regulated articles”:

Rules 3(2) and rule heading, 4(1) and (2), 5(1)(a), 6, 8(2) and 9(1).
