Sale of Food Act

(Chapter 283)

Food (Amendment) Regulations 1998

In exercise of the powers conferred by section 38(1) of the Sale of Food Act, the Minister for the Environment hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Food (Amendment) Regulations 1998 and shall come into operation on 19th June 1998.

Amendment of regulation 2

2. Regulation 2(1) of the Food Regulations (Rg 1) is amended by inserting, immediately after the words “anti-caking agents,” in paragraph (b) of the definition of “food additive”, the words “anti‑foaming agents,”.

Amendment of regulation 5

3. Regulation 5(4) of the Food Regulations is amended —

(a)

by deleting the word “and” at the end of sub‑paragraph (e)(ii); and

(b)

by deleting sub-paragraph (f) and substituting the following sub‑paragraphs:

“(f)

the following words or any other words to the same effect in the case of any food containing aspartame:

“PHENYLKETONURICS: CONTAINS PHENYLALANINE.”; and

(g)

such other particulars as are required by these Regulations to be given in the case of any particular food.”.

New regulation 16A

4. The Food Regulations are amended by inserting, immediately after regulation 16, the following regulation:

“Anti-foaming agents

16A.—(1) In these Regulations, “anti-foaming agent” means any substance which, when added to liquid food, prevents or minimises foaming of the food.

(2) Subject to paragraph (3), no person shall —

(a)	import, sell, advertise, manufacture, consign or deliver any article of food which contains an anti‑foaming agent; or
(b)	sell or advertise for sale, with a view to its use in the preparation of food for human consumption any anti‑foaming agent.

(3) Edible oil may contain the anti‑foaming agent known as dimethyl polysiloxane in an amount not exceeding 10 ppm.”.

Amendment of regulation 18

5. Regulation 18 of the Food Regulations is amended —

(a)	by inserting, immediately after the word “include” in the third line of paragraph (1), the word “aspartame,”;
(b)	by deleting the word “aspartame,” in the second line and in the third line of paragraph (2) and in the first line of paragraph (4)(a); and
(c)	by deleting sub-paragraph (b) of paragraph (4).

Amendment of regulation 21

6. Regulation 21 of the Food Regulations is amended by inserting, immediately after paragraph (2), the following paragraph:

“(2A) Non-alcoholic drinks may contain ester gum in an amount not exceeding 100 ppm.”.

Amendment of regulation 38

7. Regulation 38 of the Food Regulations is amended by deleting paragraph (2).

Amendment of regulation 39

8. Regulation 39(2) of the Food Regulations is amended by deleting sub‑paragraph (e).

Amendment of regulation 78

9. Regulation 78 of the Food Regulations is amended by inserting, immediately after the word “anti-oxidants” at the end of paragraph (1), the words “and anti‑foaming agents”.

New regulation 151A

10. The Food Regulations are amended by inserting, immediately after regulation 151, the following regulation:

“Royal jelly

151A.—(1) Royal jelly shall be the milky white viscous secretion from the salivary glands of honey bees and shall contain not less than 10 g of 10‑hydroxy‑decenoic acid per kg of royal jelly.

(2) Every label on or attached to a package or other receptacle containing royal jelly, or a food containing royal jelly, shall include, immediately after the common name, the following words or any other words to the same effect:

“WARNING — THIS PRODUCT MAY NOT BE SUITABLE FOR ASTHMA AND ALLERGY SUFFERERS.”.”

Deletion and substitution of regulation 168

11. Regulation 168 of the Food Regulations is deleted and the following regulation substituted therefor:

“Chocolate

168.—(1) Chocolate (chocolate paste, confectioner’s chocolate, chocolate coating or chocolate powder) shall be a preparation of cocoa paste, cocoa powder or cocoa, with or without the addition of cocoa fat, sugar, spices, milk solids, permitted emulsifier, and permitted flavouring agent, and may contain polyglycerol polyricinoleate in an amount not exceeding 4,000 ppm.

(2) Chocolate shall not contain any foreign fat or oil other than cocoa butter or milk fat.”.

Amendment of regulation 252

12. Regulation 252 of the Food Regulations is amended by inserting, immediately after paragraph (5), the following paragraphs:

“(6) The following nucleotides may be added to infant formula in the proportions as follows:

(a)	Cytidine 5’-Monophosphate in an amount not exceeding 2.50 mg per 100 kcal;
(b)	Uridine 5’-Monophosphate in an amount not exceeding 1.75 mg per 100 kcal;
(c)	Adenosine 5’-Monophosphate in an amount not exceeding 1.50 mg per 100 kcal;
(d)	Guanosine 5’-Monophosphate in an amount not exceeding 0.50 mg per 100 kcal; and
(e)	Inosine 5’-Monophosphate in an amount not exceeding 1.00 mg per 100 kcal.

(7) The total concentration of such nucleotides as referred to in paragraph (6) in any infant formula shall not exceed 5 mg per 100 kcal.

(8) Selenium may be added to infant formula in an amount not exceeding 3 µg per 100 kcal.”.

Amendment of Second Schedule

13. The Second Schedule to the Food Regulations is amended by inserting, immediately after the word “carob,” in the item relating to “The following gums” under the heading “Substance”, the word “gellan,”.

Amendment of Seventh Schedule

14. The Seventh Schedule to the Food Regulations is amended —

(a)	by inserting, immediately after the word “carob,” in the item relating to “Gums”, the word “gellan,”; and
(b)	by inserting, immediately after the words “starches octenyl succinic anhydride modified;” in the item relating to “Starches”, the words “hydroxypropyl distarch phosphate;”.

Amendment of Ninth Schedule

15. The Ninth Schedule to the Food Regulations is amended —

(a)

by inserting, immediately below the item “Ammonium sulphate;”, the following item:

“Aspartame;”;

(b)

by inserting, immediately below the item “Carnauba wax;”, the following item:

“Chymosin (produced by Escherichia coli);”;

(c)

by inserting, immediately below the item “Lactic acid;”, the following item:

“Lactitol;”; and

(d)

by inserting, immediately below the item “Nitrous oxide;”, the following item:

“Oligofructose (from chicory root);”.
