Notification 2019

In exercise of the powers conferred by section 40(2) of the Films Act, the Minister for Communications and Information makes the following Notification:

Citation and commencement

1. This Notification is the Films (Exemption) (Miscellaneous Amendments) Notification 2019 and comes into operation on 29 April 2019.

Amendment of Films (Exemption) Notification 2005

2. The Films (Exemption) Notification 2005 (G.N. No. S 431/2005) is amended —

(a)

by deleting the definitions of “advertise”, “advertisement”, “advertising poster” and “approved person” in paragraph 2;

(b)

by inserting, immediately after the words “where films are” in the definition of “exhibition point” in paragraph 2, the word “publicly”;

(c)

by deleting the words “Section 22” in paragraph 3 and substituting the words “Sections 22 and 22A”;

(d)

by deleting the words “approved person who intends to advertise any film” in paragraph 3 and substituting the words “person who publishes an advertisement for a film that is distributed or publicly exhibited or intended for distribution or public exhibition”;

(e)

by deleting sub-paragraphs (a) and (b) of paragraph 3 and substituting the following sub‑paragraphs:

“(a)	the advertisement states the classification rating that accords with the classification assigned to that film under the Act and the consumer advice applicable to the film (if any);
(b)	the advertising poster for any film assigned a classification rating of “R21” is only displayed in exhibition points lawfully permitted to publicly exhibit films assigned that classification rating;”; and

(f)

by deleting the words “or lesbian” in paragraph 3(f).

Amendment of Films (Exemption) Notification 2011

3. The Films (Exemption) Notification 2011 (G.N. No. S 525/2011) is amended —

(a)	by deleting the word “Board” in the definitions of “exempt film” and “exempt person” in paragraph 2 and substituting in each case the word “Authority”;
(b)	by deleting the word “Board” in paragraph 4(1)(b) and (c) and substituting in each case the word “Authority”; and
(c)	by deleting the words “Censor, Deputy or Assistant Censor or Inspector of Films” in paragraph 4(1)(g) and substituting the words “enforcement officer”.

Amendment of Films (Exemption) (No. 2) Notification 2011

4. The Films (Exemption) (No. 2) Notification 2011 (G.N. No. S 526/2011) is amended —

(a)	by deleting the word “Board” in the definitions of “exempt film” and “exempt person” in paragraph 2 and substituting in each case the word “Authority”;
(b)	by deleting the word “Board” in paragraph 4(1)(b) and (c) and substituting in each case the word “Authority”; and
(c)	by deleting the words “Censor, Deputy or Assistant Censor or Inspector of Films” in paragraph 4(1)(g) and substituting the words “enforcement officer”.
