Massage Establishments Act

Massage Establishments (Exemption) (No. 2) Order 2006
In exercise of the powers conferred by section 11 of the Massage Establishments Act, the Minister for Home Affairs hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Massage Establishments (Exemption) (No. 2) Order 2006 and shall come into operation on 26th June 2006.
Exemption
2.—(1)  Subject to sub-paragraph (2), the Minister hereby exempts the following premises from the requirement under section 4(1) of the Act for a licence to carry on an establishment for massage:
(a)any premises used exclusively for body tanning; and
(b)any premises that would require a licence under the Act only by reason of it being used for body tanning and that would not otherwise require a licence under the Act.
(2)  The premises referred to in paragraph (1) are exempted from the requirement under section 4(1) of the Act for a licence to carry on an establishment for massage only if the following requirements are satisfied:
(a)the body tanning service administered in the premises is conducted solely by means of a self-operated machine;
(b)there is no additional room, partition or cubicle within the premises other than any room, partition or cubicle that is essential for the operation of the body tanning service such as a treatment room or a changing room; and
(c)the operator of the establishment for massage registers details of the operations of the establishment with the Licensing Officer and complies with the requirements set out in the Schedule.
(3)  The Licensing Officer may, by notice in writing addressed to the operator of an establishment for massage carried on in any premises exempted under this Order, revoke the exemption if the Licensing Officer —
(a)is satisfied that the operator is not a suitable person to be allowed to carry on the business of the establishment for massage on exempted premises; or
(b)considers it in the public interest to revoke the exemption.
