Road Traffic (Exemption from Section 12) (Amendment No. 2) Order 2007
In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Transport hereby makes the following Order:
Citation and commencement
1.—(1)  This Order may be cited as the Road Traffic (Exemption from Section 12) (Amendment No. 2) Order 2007 and shall, with the exception of paragraph 2(a), (b) and (c), come into operation on 6th July 2007.
(2)  Paragraph 2(a), (b) and (c) shall be deemed to have come into operation on 28th June 2006.
Amendment of paragraph 3
2.  Paragraph 3 of the Road Traffic (Exemption from Section 12) Order 2005 (G.N. No. S 722/2005) is amended ––
(a)by deleting sub-paragraph (c) of sub-paragraph (1) and substituting the following sub-paragraph:
(c)he or his spouse is the registered owner of the vehicle, or his employer is the registered owner of the vehicle and has provided him with the vehicle, or his employer has hired the vehicle for use by him alone;”;
(b)by deleting sub-paragraph (ii) of sub-paragraph (1)(e) and substituting the following sub-paragraph:
(ii)for an aggregate of not more than 28 other days in any calendar year or such greater number of days as the Registrar may allow in cases of emergency,
or where his spouse is exempted under sub-paragraph (1A), he and his spouse keep or use the vehicle in Singapore only ––
(A)on Saturdays, Sundays and public holidays; and
(B)for a combined aggregate of not more than 28 other days in any calendar year or such greater number of days as the Registrar may allow in cases of emergency.”;
(c)by inserting, immediately after sub-paragraph (1), the following sub-paragraph:
(1A)  Where a person is exempted under sub-paragraph (1) in respect of a vehicle, his spouse shall be exempted from section 12 of the Act in respect of the vehicle during the period of validity of the approval referred to in sub-paragraph (1)(d)(i) if the following conditions are satisfied:
(a)the spouse is a citizen or permanent resident of Singapore, and resides in Malaysia;
(b)the person, the spouse or the person’s employer is the registered owner of the vehicle;
(c)there is in force in respect of the vehicle a valid approval under rule 3A of the Road Traffic (Exemption from Section 12 — Approval) Rules 2005 (G.N. No. S 721/2005) in relation to the use of the vehicle by the spouse.”;
(d)by inserting, immediately after the words “permanent resident of Malaysia” in sub-paragraph (2)(b), the words “who is not also a citizen or permanent resident of Singapore”; and
(e)by inserting, immediately after the words “calendar year” in sub-paragraph (2)(f)(ii), the words “or such greater number of days as the Registrar may allow in cases of emergency”.
Transitional and savings provision
3.  A person who is exempted from section 12 of the Act under paragraph 3(2) of the Road Traffic (Exemption from Section 12) Order 2005 in force immediately before 6th July 2007 shall, if the period of validity of the approval for such exemption had not expired by that date, continue to be so exempted as if this Order had not been made until ––
(a)the expiry of that period; or
(b)the date the exemption ceases to be valid under the law in force immediately before 6th July 2007,
whichever occurs first.
