(Non-Ionising Radiation)
(Amendment) Regulations 2023

In exercise of the powers conferred by section 57(1) of the Radiation Protection Act 2007, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:

Citation and commencement

1. These Regulations are the Radiation Protection (Non‑Ionising Radiation) (Amendment) Regulations 2023 and come into operation on 26 June 2023.

Amendment of regulation 2

2. In the Radiation Protection (Non‑Ionising Radiation) Regulations (Rg 1), in regulation 2(1), replace the definition of “healthcare institution” with —

“ “healthcare institution” means —

(a)	any premises at which a licensee under the Healthcare Services Act 2020 is approved under section 11B of that Act to provide a licensable healthcare service;
(b)	any conveyance that a licensee under the Healthcare Services Act 2020 is approved under section 11B of that Act to use to provide a licensable healthcare service; or
(c)	any premises licensed under the Private Hospitals and Medical Clinics Act 1980 as a healthcare institution within the meaning of that Act;”.

Amendment of regulation 14

3. In the Radiation Protection (Non‑Ionising Radiation) Regulations, in regulation 14, replace paragraph (4) with —

“(4) In this regulation, “individual in charge” means —

(a)	in relation to a healthcare institution where a licensee under the Healthcare Services Act 2020 provides a licensable healthcare service — the Principal Officer of the licensee; and
(b)	in relation to a healthcare institution licensed under the Private Hospitals and Medical Clinics Act 1980 — the chief executive of the healthcare institution, or any individual holding an equivalent position in the healthcare institution,

and includes any individual authorised to act in that capacity.”.
