Home Affairs Uniformed Services (INVEST Plan) (Amendment) Regulations 2004
In exercise of the powers conferred by section 3 of the Home Affairs Uniformed Services Superannuation Act, the Minister for Home Affairs hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Home Affairs Uniformed Services (INVEST Plan) (Amendment) Regulations 2004 and shall come into operation on 12th July 2004.
Amendment of regulation 2
2.  Regulation 2(1) of the Home Affairs Uniformed Services (INVEST Plan) Regulations (Rg 2, 2004 Ed.) (referred to in these Regulations as the principal Regulations) is amended by inserting, immediately after the definition of “CPF Top-Up Account”, the following definition:
“ “discharge from the Police Force” means a discharge under section 20 of the Police Force Act (Cap. 235), regulation 71 of the Police Regulations (Cap. 235, Rg 1) or any other provision of that Act;”.
Amendment of regulation 12
3.  Regulation 12 of the principal Regulations is amended —
(a)by deleting the word “and” at the end of paragraph (1)(c);
(b)by deleting the full-stop at the end of sub-paragraph (d) of paragraph (1) and substituting the word “; and”, and by inserting immediately thereafter the following sub-paragraph:
(e)any other sums specified by these Regulations.”; and
(c)by inserting, immediately after paragraph (3), the following paragraph:
(3A)  The Board may withhold any contribution payable to the account of any member under paragraph (1) if that member is in remand, custody, confinement, detention or under suspension or interdiction from duty pending trial by a court or disciplinary proceedings, but immediately on a finding of not guilty on all the charges against the member, any withheld contributions shall be credited to the member’s accounts.”.
Amendment of regulation 13
4.  Regulation 13(1) of the principal Regulations is amended —
(a)by deleting the word “or” at the end of sub-paragraph (b); and
(b)by deleting the full-stop at the end of sub-paragraph (c) and substituting the word “; or”, and by inserting immediately thereafter the following sub-paragraph:
(d)is dismissed from the service or discharged from the Police Force, subject to any forfeiture under regulation 17.”.
Amendment of regulation 15
5.  Regulation 15(1) of the principal Regulations is amended —
(a)by deleting the word “or” at the end of sub-paragraph (c);
(b)by deleting the comma at the end of sub-paragraph (d) and substituting the word “; or”, and by inserting immediately thereafter the following sub-paragraph:
(e)is discharged from the Police Force,”; and
(c)by deleting the words “death or dismissal” and substituting the words “death, dismissal or discharge”.
Amendment of regulation 17
6.  Regulation 17 of the principal Regulations is amended by inserting, immediately after the word “service”, the words “or discharged from the Police Force”.
Amendment of regulation 18
7.  Regulation 18 of the principal Regulations is amended —
(a)by deleting the words “Retirement Account” in paragraph (2)(a) and substituting the words “Retention Account or Retirement Account or both, as the case may be,”;
(b)by inserting, immediately after paragraph (2), the following paragraph:
(2A)  Notwithstanding paragraph (1) or (1A), no sum credited to a member’s Retirement Account under regulation 33 shall vest in the member unless the member retires on the ground specified in regulation 11(1)(a) or (c).”;
(c)by deleting the words “paragraphs (1), (2) and (3)” in paragraph (4) and substituting the words “paragraphs (1), (1A), (2), (2A) and (3)”; and
(d)by inserting, immediately after the word “service” in paragraph (5), the words “or discharged from the Police Force”.
Amendment of regulation 19
8.  Regulation 19 of the principal Regulations is amended —
(a)by inserting, immediately after the words “public service” in paragraphs (2) and (2A), the words “or discharged from the Police Force”;
(b)by deleting the words “resignation or (as the case may be) dismissal” in paragraph (2A) and substituting the words “resignation, dismissal or discharge, as the case may be”; and
(c)by deleting the words “resignation or dismissal from the public service” in paragraph (4) and substituting the words “resignation, dismissal from the public service or discharge from the Police Force”.
Amendment of regulation 27
9.  Regulation 27(1) of the principal Regulations is amended by inserting, immediately after the words “all moneys” in sub-paragraph (i), the words “, whether vested or not,”.
Deletion of regulation 37
10.  Regulation 37 of the principal Regulations is deleted.
