(Saving and Transitional Provisions)
Regulations 2023
In exercise of the powers conferred by section 29(6) of the Healthcare Services (Amendment) Act 2023, the Minister for Health makes the following Regulations:
Citation and commencement
1.  These Regulations are the Healthcare Services (Amendment) Act 2023 (Saving and Transitional Provisions) Regulations 2023 and come into operation on 26 June 2023.
Approvals for specified services under clinical laboratory service licence and radiological service licence
2.—(1)  The Director-General may, under section 11D of the Act as in force on or after 26 June 2023, grant —
(a)to a clinical laboratory service licensee who had specified in the licence application or given written notice under regulation 4(3) of the relevant Regulations to the Director of Medical Services before 26 June 2023 that the clinical laboratory service licensee provides a laboratory discipline or specified test — an approval to provide the laboratory discipline or specified test as a specified service;
(b)to a radiological service licensee who had specified in the licence application or given written notice under regulation 4(3) of the relevant Regulations to the Director of Medical Services before 26 June 2023 that the radiological service licensee provides plain x‑ray as an imaging modality — an approval to provide plain radiography as a specified service; and
(c)to a radiological service licensee who had specified in the licence application or given written notice under regulation 4(3) of the relevant Regulations to the Director of Medical Services before 26 June 2023 that the radiological service licensee provides an imaging modality other than plain x‑ray — an approval to provide the imaging modality as a specified service,
even though an application for the approval has not been made by that licensee.
(2)  In this regulation —
“clinical laboratory service licensee” means a person who, immediately before 26 June 2023, holds a licence to provide a clinical laboratory service;
“imaging modality” has the meaning given by regulation 4(4) of the relevant Regulations as in force immediately before 26 June 2023;
“laboratory discipline” has the meaning given by regulation 4(4) of the relevant Regulations as in force immediately before 26 June 2023;
“radiological service licensee” means a person who, immediately before 26 June 2023, holds a licence to provide a radiological service;
“relevant Regulations” means the Healthcare Services (Clinical Laboratory Service and Radiological Service) Regulations 2021 (G.N. No. S 1036/2021);
“specified test” has the meaning given by regulation 4(4) of the relevant Regulations as in force immediately before 26 June 2023.
Approvals for permanent premises and specified service under nuclear medicine service
3.—(1)  The Director-General may —
(a)under section 11B of the Act as in force on or after 26 June 2023, grant a person who holds an applicable licence an approval to provide a nuclear medicine service at the licensed premises specified in the applicable licence as approved permanent premises; and
(b)under section 11D of the Act as in force on or after 26 June 2023, grant a person who holds an applicable licence an approval to provide nuclear medicine imaging as a specified service for a nuclear medicine service,
even though an application for the approval has not been made by that person.
(2)  In this regulation —
“applicable licence” means a nuclear medicine imaging service licence in force immediately before 26 June 2023;
“licensed premises” means the premises specified in an applicable licence as premises at which a nuclear medicine imaging service may be provided;
“nuclear medicine imaging service” has the meaning given by paragraph 2 of the First Schedule to the Act as in force immediately before 26 June 2023;
“nuclear medicine service” has the meaning given by paragraph 2 of the First Schedule to the Act.
