Public Order (Unrestricted Area) Order 2009
In exercise of the powers conferred by section 14 of the Public Order Act 2009, the Minister for Home Affairs hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Public Order (Unrestricted Area) Order 2009 and shall come into operation on 9th October 2009.
Unrestricted area
2.  The area in Hong Lim Park and delineated in the Schedule is designated as an unrestricted area whereby no notice under section 6, and no permit under section 7, of the Act shall be required for the holding of all assemblies or processions or both therein.
Public speaking in unrestricted area
3.—(1)  Any lecture, talk, address, debate or discussion (whether or not in combination with a play-reading, recital, performance or exhibition) held in an unrestricted area must be carried out in compliance with all of the following conditions:
(a)the lecture, talk, address, debate or discussion must be by a citizen of Singapore (referred to in this Order as the speaker) and not a non-citizen;
(b)the speaker does not deal with any matter —
(i)which relates, directly or indirectly, to any religious belief or to religion generally; or
(ii)which may cause feelings of enmity, hatred, ill-will or hostility between different racial or religious groups in Singapore;
(c)the speaker speaks using only any of the 4 official languages in Singapore, or any related dialect; and
(d)the speaker does not display or exhibit, or cause to be displayed or exhibited (whether before, during or after the lecture, talk, address, debate or discussion), any banner, flag, poster, placard, photograph, film, sign, writing or other visible representation or paraphernalia which contains any violent, lewd or obscene material.
(2)  If any speaker at any lecture, talk, address, debate or discussion (whether or not in combination with a play-reading, recital, performance or exhibition) held in an unrestricted area contravenes any condition specified in sub-paragraph (1), the speaker shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 6 months or to both.
Demonstrations in unrestricted area
4.—(1)  The organising of and taking part in any demonstration (whether or not in combination with a play-reading, recital, performance or exhibition) held in an unrestricted area must be in compliance with all of the following conditions:
(a)the demonstration must be organised by a citizen of Singapore (referred to in this paragraph as the organiser) and not a non-citizen;
(b)the demonstration does not deal with any matter —
(i)which relates, directly or indirectly, to any religious belief or to religion generally; or
(ii)which may cause feelings of enmity, hatred, ill-will or hostility between different racial or religious groups in Singapore;
(c)the organiser, or an authorised agent of the organiser, is present at all times during the demonstration; and
(d)no banner, flag, poster, placard, photograph, film, sign, writing or other visible representation or paraphernalia which contains any violent, lewd or obscene material is displayed or exhibited (whether before, during or after the demonstration) by or on behalf of the organiser or by any person taking part in the demonstration.
(2)  If any organiser of a demonstration (whether or not in combination with a play-reading, recital, performance or exhibition) held in an unrestricted area contravenes any condition specified in sub-paragraph (1), the organiser shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 6 months or to both.
(3)  If any person taking part in a demonstration (whether or not in combination with a play-reading, recital, performance or exhibition) held in an unrestricted area contravenes any condition specified in sub-paragraph (1)(d), the person shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $3,000 and, on a second or subsequent conviction, to a fine not exceeding $5,000.
Saving
5.  Nothing in this Order shall be construed to limit or in any way affect the operation of any other written law.
