Online Criminal Harms Act 2023
(Amendment of First and Second Schedules)
Order 2024
In exercise of the powers conferred by section 59(1) of the Online Criminal Harms Act 2023, the Minister for Home Affairs makes the following Order:
Citation and commencement
1.—(1)  This Order is the Online Criminal Harms Act 2023 (Amendment of First and Second Schedules) Order 2024 and, except for paragraph 3, comes into operation on 24 June 2024.
(2)  Paragraph 3 comes into operation on 24 June 2024 at 12.01 a.m.
Amendment of First Schedule
2.  In the Online Criminal Harms Act 2023, in the First Schedule —
(a)in Part 1, replace item 24 with —
24.Offences under —
(a)sections 19, 25, 27, 47, 49 and 50 of the Moneylenders Act 2008; and
(b)rules made under section 93 of that Act to provide for —
(i)the detection and prevention of money laundering, terrorism financing or the financing of proliferation of weapons of mass destruction; or
(ii)the reporting of transactions suspected of involving money laundering, terrorism financing or the financing of proliferation of weapons of mass destruction.”;
(b)in Part 1, in item 30, replace “and Terrorism Financing” with “, Terrorism Financing and Proliferation Financing”;
(c)in Part 2, in item 2, after “sections”, insert “170,”;
(d)in Part 2, after item 2, insert —
2A.The following offences under the Securities and Futures Act 2001:
(a)offences under section 204 for contravention of section 197, 199, 200, 201, 201A, 201B or 202;
(b)offences under section 210 for contravention of section 207 or 209.”; and
(e)in Part 2, in item 3, replace “and 2” with “, 2 and 2A”;
Amendment of Second Schedule
3.  In the Online Criminal Harms Act 2023, in the Second Schedule, in Part 1 —
(a)in item 2, after “sections”, insert “170,”;
(b)after item 2, insert —
2A.The following offences under the Securities and Futures Act 2001:
(a)offences under section 204 for contravention of section 197, 199, 200, 201, 201A, 201B or 202;
(b)offences under section 210 for contravention of section 207 or 209.”; and
(c)in item 3, replace “and 2” with “, 2 and 2A”.
