Regulations 2021

In exercise of the powers conferred by section 111 of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:

Citation and commencement

1. These Regulations are the Environmental Public Health (Registration of Environmental Control Officers) (Amendment) Regulations 2021 and come into operation on 20 July 2021.

Amendment of regulation 1

2. Regulation 1 of the Environmental Public Health (Registration of Environmental Control Officers) Regulations (Rg 2) (called in these Regulations the principal Regulations) is amended by deleting the words “Registration of Environmental Control Officers” and substituting the words “Construction Sites”.

Amendment of regulation 2

3. Regulation 2 of the principal Regulations is amended by deleting the definition of “employ” and substituting the following definitions:

“ “construction site” means any construction site to which section 62 of the Act applies;

“Environmental Control Officer” means any individual who is registered under the Act as an Environmental Control Officer authorised to act for construction sites;”.

Deletion of regulations 3 to 8

4. The principal Regulations are amended by deleting regulations 3 to 8.

Amendment of regulation 15

5. Regulation 15 of the principal Regulations is amended —

(a)	by deleting “6(5),” in paragraph (a); and
(b)	by deleting “5,” in paragraph (b).

Miscellaneous amendments

6. The principal Regulations are amended —

(a)

by deleting the word “employed” in the following provisions and substituting in each case the word “appointed”:

Regulations 10(1), 12(a), (b) and (c) and 14(a), (b) and (c);

(b)

by deleting the word “employment” in the following provision and substituting in each case the word “appointment”:

Regulation 12(a) and (b) and the regulation heading;

(c)

by deleting the word “employ” in regulation 12(b) and (c) and substituting in each case the word “appoint”; and

(d)

by deleting the word “employs” in regulation 13 and substituting the word “appoints”.
