Control Officers) (Amendment)
Order 2021

In exercise of the powers conferred by section 62(1) of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Order:

Citation and commencement

1. This Order is the Environmental Public Health (Employment of Environmental Control Officers) (Amendment) Order 2021 and comes into operation on 20 July 2021.

Amendment of paragraph 1

2. Paragraph 1 of the Environmental Public Health (Employment of Environmental Control Officers) Order (O 1) (called in this Order the principal Order) is amended by deleting the word “Employment” and substituting the word “Appointment”.

Amendment of paragraph 2

3. Paragraph 2 of the principal Order is amended —

(a)

by inserting, immediately before the definition of “contract sum”, the following definition:

“ “construction site” means any construction site to which section 62 of the Act applies;”; and

(b)

by inserting, immediately after the definition of “contract sum”, the following definition:

“ “Environmental Control Officer” means any individual who is registered under the Act as an Environmental Control Officer authorised to act for construction sites;”.

Amendment of paragraph 4

4. Paragraph 4 of the principal Order is amended —

(a)	by deleting the words “employ a competent person to act as an Environmental Control Officer in” in sub‑paragraphs (1) and (2) and substituting in each case the words “appoint an Environmental Control Officer for”; and
(b)	by deleting the word “Employment” in the paragraph heading and substituting the word “Appointment”.

Amendment of paragraph 5

5. Paragraph 5 of the principal Order is amended by deleting the word “employed” wherever it appears in sub‑paragraphs (1) and (2) and substituting in each case the word “appointed”.
