Poisons Act

Poisons (Amendment) Rules 2008
In exercise of the powers conferred by section 20(1) of the Poisons Act, the Minister for Health hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Poisons (Amendment) Rules 2008 and shall come into operation on 1st November 2008.
Amendment of rule 2
2.  Rule 2(1) of the Poisons Rules (R 1) is amended —
(a)by inserting, immediately after the definitions of “British Pharmacopoeia” and “Pharmaceutical Codex”, the following definition:
“ “codeine cough preparation” means any medicine in liquid form that contains codeine and is intended for the treatment of coughs;”;
(b)by inserting, immediately after the definition of “registered nurse”, the following definition:
“ “registered pharmacy” means a pharmacy registered under section 37 of the Medicines Act (Cap. 176);”; and
(c)by deleting the full-stop at the end of the definition of “sale by wholesale” and substituting a semi-colon, and by inserting immediately thereafter the following definition:
“ “sell by retail”, in relation to any poison, means to sell the poison otherwise than by wholesale.”.
New rule 14A
3.  The Poisons Rules are amended by inserting, immediately after rule 14, the following rule:
Exemption for retail sale of poisons by pharmacists
14A.—(1)  The prohibition under section 5 of the Act against the possession for sale, sale or offer for sale of any poison without a licence from a licensing officer shall not apply to a pharmacist who sells any poison by retail in a registered pharmacy.
(2)  Section 6(1)(a) of the Act shall not apply to a pharmacist who sells any poison by retail in a registered pharmacy.”.
New rule 17
4.  The Poisons Rules are amended by inserting, immediately after rule 16, the following rule:
Restrictions on sale of codeine cough preparations by pharmacists
17.  A pharmacist who sells codeine cough preparations by retail —
(a)shall not sell more than a total of 240ml of any one or more codeine cough preparations to any one customer on any one occasion;
(b)shall not sell any codeine cough preparation to the same customer more than once within a period of 4 days (including Sundays and public holidays);
(c)shall provide professional counselling on the use of codeine cough preparations to each customer to whom he sells any codeine cough preparation; and
(d)shall record, on a daily basis in a book which is kept exclusively for this purpose, the following particulars in respect of the sale to each customer of any codeine cough preparation:
(i)the name and identity card number of the customer; and
(ii)the quantity of codeine cough preparation sold to the customer.”.
Amendment of rule 35
5.  Rule 35 of the Poisons Rules is amended by deleting the words “rule 23” in paragraph (a) and substituting the words “rule 17, 23”.
